Deputies of the State Council (Parliament) of Tatarstan are concerned about the “extremely low” sanctions for violating the rules of hunting in Russia. They propose to increase the minimum fine for violators by four times – from 500 to 2 thousand rubles, by introducing a minimum term for deprivation of a hunting license for one year. Such measures are contained in the draft federal law “On Amendments to Art. 8.37 of the Code of Administrative Offenses of the Russian Federation. The authors of the initiative cite statistics, according to which in 2019–2021, 122 thousand violations of the requirements of hunting rules were detected in Russia, while more than 80% of them were fined 500 rubles.
The draft federal law on strengthening responsibility for violation of hunting rules was submitted to the State Duma on behalf of the State Council of Tatarstan by its speaker Farid Mukhametshin. The text of the document on Monday was registered in the Duma’s electronic database.
Deputies of the State Council propose to amend Part 1 of Art. 8.37 of the Code of Administrative Offenses of the Russian Federation (violation of the rules of hunting). Now it provides citizens with a fine of 500 rubles. up to 4 thousand rubles “with or without confiscation of hunting tools or deprivation of the right to hunt for up to two years.” According to Tatarstan parliamentarians, the minimum fine should be increased to 2,000 rubles. In addition, the project of Tatarstan establishes a minimum period of deprivation of the right to hunt – one year (now there is no lower bar). For officials, the amount of punishment is proposed to be left unchanged – from 20 thousand to 35 thousand rubles. with or without confiscation of hunting tools.
The explanatory note to the bill says that in 2019–2021, 122,000 violations of the requirements of hunting rules were identified in the Russian Federation. However, for more than 80% of them, the minimum amount of an administrative fine is assigned – 500 rubles. During this period, “as a result of violation of the rules of hunting, 193 people were injured with a fatal outcome,” the State Council indicates. And the hunting resources of the Russian Federation were damaged in the amount of 79.8 million rubles. (51.6 million rubles were recovered as compensation for damage), the parliament of the republic refers to the data of the Ministry of Natural Resources of Russia.
Penalties for violating hunting rules “remain extremely low,” deputies of Tatarstan point out: “The established limits on administrative fines currently do not meet the requirements of proportionality of punishment to the offense committed.” The authors of the initiative give the following example: the state duty for issuing a permit for the extraction of hunting resources is only 650 rubles, while the damage from illegal duck hunting is 1.8 thousand rubles. “Also, when depriving the right to hunt for less than one year, the violator is actually deprived of only one period of seasonal hunting,” the parliament of the republic notes.
The deputies point out that in three years 5.5 thousand criminal cases were initiated against violating hunters. 1.1 thousand people were brought to justice. “The result of such a large number of persons prosecuted was non-compliance with the rules of hunting,” the parliamentarians conclude. They believe that the tightening of sanctions will be “an economic incentive for violators to comply with the rules of hunting.”
It should be noted that the bill of the State Council was supported by the deputies of Tatarstan unanimously at a meeting in September last year. Ildar Gilmutdinov, deputy of the lower house from the republic, was entrusted to represent the project in the State Duma. Tatarstan’s initiative received a positive response from the government of the Russian Federation. However, the White House indicated that the project materials should be supplemented with an analysis of statistics that would confirm “the insufficiency and inefficiency of the current measures of administrative responsibility.” Deputy Chairman of the Tatarstan State Council Committee on Law and Order Alexander Chubarov assured Kommersant that such information had already been submitted to the State Duma: “We prepared and sent it in a new way.”
President of Rosokhotrybolovsoyuz Tatyana Aramileva, in a conversation with Kommersant, noted that there are no publicly available statistics on the number of offenses in the field of hunting: “We do not know who, how many and when they committed them. What exactly are hunting offenses? Under what article are they fined and which of the hunting rules are they violating?” She recalled that regional authorities have powers in the field of hunting, but there are not enough specialists in the regions.
“Fines can be increased indefinitely, but the main question is: how will it work and who will monitor it? – points out biologist-hunter Valery Kuzenkov. – If we have one inspector in the Murmansk region with a salary of 20-25 thousand rubles. into four regions. And in the Yaroslavl region, the bodies of the state hunting economy were reduced by 30%. According to him, in order to solve the problems with offenses in hunting, it is necessary to create a professional service, raise the prestige of the work of state inspectors, provide them with the necessary equipment, means of communication, clothing and social benefits.
