The Samara branch of the unregistered Libertarian Party of Russia reported that Yegor Beschastnov, a member of the party, ex-candidate for municipal deputies, was taken to the military registration and enlistment office against his will. There, an urgently convened draft board decided to send the oppositionist to urgent military service. Previously, he submitted two applications for alternative service in connection with pacifist views, but in the first case he was denied a draft board, the second application, according to his lawyer, was not considered.
“Egor Beschastnov was assigned a control turnout on December 1st. Sending to the army is scheduled for December 6, ”the message of the party Telegram channel.
In February, Yegor Beschastnov participated in an unauthorized action against a special military operation. He was later arrested for 30 days as its organizer. In March, at the exit from the special detention center, the libertarian was handed a summons to the military registration and enlistment office. The young man applied for alternative civilian service, declaring pacifist views. However, the draft board refused him, and the courts of first and second instances upheld this decision. In September, the activist submitted a new application for alternative service.
Lawyer Arseniy Levinson, representing the interests of the oppositionist, called the actions of the police and military commissariat officers violating human rights: “It is illegal to hold all recruiting events on one day. It is unlawful forcibly, with the help of the police, to deliver a person to the military registration and enlistment office for these events. This is arbitrariness and violation of authority.”
Mr. Levinson explained that the police can deliver “to the police department, and not to the military registration and enlistment office” citizens who violated the rules of military registration, for example, did not appear on the agenda. But even in this case, the police can only draw up a protocol on an administrative offense. “Yegor Beschastnov did not allow such violations. His second application for alternative civilian service was not considered by the draft board. In addition, no medical examination was carried out,” Mr. Levinson said.
The lawyer intends to file a lawsuit on the illegality of the decision of the draft commission to leave the second application for conscription for alternative service without consideration: “The military registration and enlistment office refused to submit the second application for consideration by the draft commission, referring to the previous decision. Which is illegal, since the draft board, when providing new arguments, may make a different decision.”
