Samara deputy could not challenge the fine for discrediting the army with noodles on the ears

The Samara Regional Court upheld the decision of the Novokuibyshevsk City Court in the case of “noodles on the ears” of the deputy of the provincial Duma from the Communist Party Mikhail Abdalkin. The decision was made today, May 11.
Earlier, the first instance fined the parliamentarian for discrediting the armed forces of the Russian Federation (part 1 of article 20.3.3 of the Code of Administrative Offenses). According to the deputy’s representatives, “the decision is illegal and politically motivated, and the conclusions are not based on the legislation on administrative offenses.”
“We have not yet seen a reasoned decision, we only know that the court left the decision of the Novokuibyshevsk city court unchanged and our complaint was not satisfied. We don’t know what he motivated this with, what arguments he considered the most significant in favor of leaving the decision unchanged, ”Alexey Lapuzin, Mikhail Abdalkin’s lawyer, explained to Kommersant.
Representatives of the deputy will challenge the decision of the regional court in the Sixth Court of Cassation of General Jurisdiction.
The last meeting of the regional court on May 4 was postponed and the deputy chairman of the Samara provincial Duma, Marina Antimonova, was summoned to court. Mikhail Abdalkin reported that it was at her request that the deputies listened to the President’s message. However, Ms. Antimonova did not come to the court session today.
The scandal with communist deputy Mikhail Abdalkin broke out in February when he posted a video on social networks in which he was watching a fragment of the message of Russian President Vladimir Putin with noodles on his ears. The regional parliament immediately reacted to the situation by declaring a public reprimand to the deputy and recommending that the regional committee of the Communist Party of the Russian Federation expel him from the party. In addition, the Gubernia Duma appealed to law enforcement agencies. As a result, an administrative protocol was drawn up against Mikhail Abdalkin for discrediting the armed forces of the Russian Federation. The court fined him 150 thousand rubles.
