The head of Chechnya, Ramzan Kadyrov, criticized the inclusion by the Ministry of Justice of Sahih al-Bukhari in the list of extremist materials. The collection of Islamic traditions of the Sunnis was previously recognized by the courts of Tatarstan as extremist, but Mr. Kadyrov called the book “second in importance after the Koran” and accused the courts of incompetent expertise. The 960-page Sahih al-Bukhari, published in 2007, Ministry of Justice of the Russian Federation recognized as extremist material on 29 August. The department was guided by the decision of the Laishevsky District Court of Tatarstan of December 2021 (confirmed in July 2022 by the Republican Supreme Court). In turn, Ramzan Kadyrov mentions in his appeal the expertise of the Moscow Islamic University. “Islam obliges Muslims to protect the interests of the state … if the state does not infringe on religion. Caricatures of the best of people, actions against hijabs, rallies against Muslims – all this led to the degradation of society to a level below the animal,” the President of Chechnya believes, calling for a review of the decision to recognize Sahih al-Bukhari as an extremist publication.
The first deputy chairman of the Council of Muftis of Russia, Rushan Abbyasov, confirms that “Muslims in Russia are again faced with the ban on classical literature.” “The Sunnah of the Prophet Muhammad (peace be upon him), set forth in reliable hadiths, is the second source of religious knowledge and Muslim law after the Holy Quran. Therefore, the ban on one of the translations of the most authoritative collection of hadiths, Sahih al-Bukhari, is completely unacceptable,” Rushan Abbyasov said. He expressed confidence that the book would be removed from the extremist list.
Alexander Verkhovsky, head of the Sova information and analytical center (included in the register of foreign agents), says that “authoritative medieval Islamic sources, or rather their translations, have been banned more than once.” He connects the situation with “Sahih al-Bukhari” with the fact that the translation of the medieval text “reads as if modern”: “And of course, it turns out to be extremism. The expert recalls that such bans – for example, on one of the translations of the Koran – have already been canceled.
In 2015, the recognition by the city court of Yuzhno-Sakhalinsk of the book “Prayer to God: Its Purpose and Place in Islam” as extremist was canceled after a similar protest by Ramzan Kadyrov.
Then this situation even led to the adoption of legislative amendments prohibiting the recognition of the sacred texts of world religions as extremist, says Roman Lunkin, head of the Center for the Study of Religion and Society at the Institute of Europe of the Russian Academy of Sciences. “From time to time, there are cases when it is easier for a district court to decide to ban a book that raises questions from believers and law enforcement agencies, just in case or because of a few inaccurate phrases,” says Mr. Lunkin. “Examination in such cases is used by voluntaristic Thus, there are no clear requirements for an expert in the law, and in assessing the conclusions on the collection of hadiths, one should agree with Ramzan Kadyrov.” The expert believes that the situation with Sahih al-Bukhari shows “characteristic features of the vicious practice of applying the law in this area.”
