The representative of the court explained that the claims of the department are related to the publication of a database of employees in the Telegram channels, the protocol was drawn up under part 1 of article 13.11 (Processing of personal data in cases not provided for by the legislation of the Russian Federation or processing of personal data incompatible with the purposes of collecting personal data) . The fine in this case can be from 60,000 to 100,000 rubles.

In December, the head of the Ministry of Digital Development, Maksut Shadayev, said that the department had developed a bill on turnover fines for companies for leaking users’ personal data, they could amount to 3% of the organization’s turnover. The Minister also called the situation with the leakage of personal data “serious” and “difficult”. On January 13, Russian President Vladimir Putin instructed the government to consider introducing turnover fines for companies that leaked personal data by July 1.

According to the amendments to the law “On Personal Data”, which came into force on September 1, 2022, in the event of a data leak, the operator is obliged to notify Roskomnadzor within 24 hours, and within 72 hours to provide the department with the results of an internal investigation indicating the reason and those responsible. persons. Currently, the maximum fine for a business for a data breach is RUB 500,000. (Article 13.11 of the Code of Administrative Offenses of the Russian Federation).
