Queues of mobilized people lined up at the notaries

On mobilization, men are called, most of whom own property, and some own businesses. This means that a notary is needed to issue the appropriate powers of attorney for those who remain to wait. Therefore, in Moscow, and not only, there are queues in notaries’ offices. “MK” found out what the townspeople are now going to notaries with.

The fact that, when preparing for mobilization, reservists should not only take care of equipment, but also draw up some documents, they wrote on social networks from the first days after September 21. And after September 25, those who came to the notary “with their feet” are increasingly meeting large queues in offices. Pre-registration for the coming days in some offices is not available at all.

“The next window is in a week,” an assistant to a notary acting in the SAO told MK. The employee of the office did not tell about the contingent of visitors, however, she said that the majority did not have hereditary cases (requiring long work and tied territorially), but the execution of powers of attorney.

In another notary’s office operating in SZAO, the MK correspondent was also informed that the queue was full in the coming days. And they gave advice: if the matter is urgent (in particular, due to urgent mobilization), you can contact any office in Moscow.

At the same time, there are several offices in the city that specialize in in-line customer service – they employ at least a dozen assistants, more than one hundred customers pass here every day, and protocols for their routing have been developed. One of these notaries (Central Administrative District, Pushkinskaya Square) found a live queue of several dozen people – more than the rather spacious waiting room can accommodate. A significant part of those waiting turned out to be really men who came to complete the necessary documents before being sent to the army.

“I am making a power of attorney for an apartment and a car,” says 37-year-old Oleg. – Just in case, so that my wife can fully manage everything without me.

Several other people in the queue also reported that they were doing powers of attorney. There was no talk about other documents, however, when communicating with notary assistants, visitors often talk about wills.

– These documents are not interchangeable, – said the notary’s assistant. – A will makes it possible to accurately determine the heirs, but a power of attorney gives the right to promptly dispose of property during the life of the principal. That is, if you draw up a power of attorney, but do not make a will, in the worst case, the inheritance will be distributed according to the law.

In the memos, mobilized people are advised to leave general powers of attorney for loved ones to represent interests (for example, in a management company or court) and to dispose of significant property (transport, real estate). A separate conversation is about individual entrepreneurs: for them, the volume of papers required for registration is greater.

– For an individual entrepreneur, if the owner himself is also the general director, you need to issue either a power of attorney for the full conduct of business in favor of the trustee, or quickly appoint a new general director, – explains lawyer Inna Darmanyan.

According to the expert, you may also need a power of attorney to represent interests in a bank (in the form of a bank), tax office, FIU and other government agencies and licensing organizations, as well as legal representation on behalf of an individual entrepreneur.

– Shareholders of companies will also need a power of attorney for corporate activities, – Darmanyan explained. – This is participation in meetings, signing of protocols and decisions, payment of dividends and so on.

And one more thing that you can forget in a hurry, but which will not be superfluous: the fathers of underage children, leaving for mobilization, can (and possibly need to) sign a consent to the movement, including the departure of children abroad with other relatives.

Recall that on September 28, the Federal Notarial Chamber made for the mobilized free of charge the execution of powers of attorney and the issuance of consents to the legal representatives of minors.

And a little about those things that cannot be inherited officially, even with the help of a notary. The same FNP reported that a notary cannot issue a certificate of inheritance in relation to depersonalized cryptocurrency wallets. The reason is simple: it is impossible to identify such a wallet in an unambiguous way (as, in fact, it is conceived). This means that the wallet owners themselves will have to take care of the transfer of appearances and passwords.
