The City Court of St. Petersburg partially satisfied in the appeal the claim of Alexander Shatsky against Yandex.Eda LLC for compensation for moral damage, thereby canceling the decision of the lower court in the case of leakage of personal data. In March 2022, a St. Petersburg resident learned about a data leak of service clients. On the Internet, he found information about himself on one of the sites, after which he filed a lawsuit against the company in the Kuibyshevsky District Court, demanding compensation. The applicant estimated moral damage at 50 thousand rubles. However, in March of this year, the court decided that Yandex.Eda was not involved in the leak of its data, and rejected Mr. Shatsky’s claim.
The resolution stated that the screenshot of the website page, which the plaintiff attached to the case materials, does not contain information allowing this resource to be attributed to the defendant, as well as information that the source of the information posted there was Yandex.Food.
In response, the plaintiff filed an appeal. At the last hearing in the City Court, it was decided to collect 5 thousand rubles in compensation from the defendant.
“The court indicated that the subject of proof in this case is the fact of illegal actions of the defendant’s employees and officials, as a result of which the plaintiff suffered moral damage, as well as the fact of causing moral damage to the plaintiff and the existence of a causal relationship between the damage caused and the actions (inaction) of the defendant “, the press service said in a statement.
A representative of the company did not admit the claim and asked that the demands be rejected, citing the fact that the information had been disseminated was not proven.
