Alla Pugacheva, through social networks, turned to the Ministry of Justice with a request to include her in the register of foreign agents – in solidarity with her husband, who received this “title” on September 16. MK found out what restrictions she would face if the authorities granted her request, and what requirements she would have to fulfill.
The question “is it possible, in principle, to write down Alla Pugacheva as a foreign agent?” doesn’t make sense. It is enough to read Russian laws and recall the practice of recent years to make sure that, if desired, any public figure can be declared an “agent”. And there is no need to establish a connection between “foreign” money and these estimates: you gave a concert in any post-Soviet country at least once in the last 10-15 years, money was transferred from there to your account – and that’s it. Yes, and money is not obligatory: obscure “other organizational and methodological assistance” is enough …
To imagine what kind of trouble Alla Borisovna can face, we must remember that now Russia maintains four “agency” registers with different sets of requirements and restrictions. One includes NGOs, another includes associations without forming a legal entity, the third includes foreign media agents, and the fourth includes individuals. It can be assumed that Alla Pugacheva has a chance to get into the same register where, since September 16, her husband Maxim Galkin (recognized as a foreign agent) has been listed, and since the beginning of September, Andrey Makarevich (recognized as a foreign agent): this is a register of individuals-foreign agents. The law on them, adopted at the very end of 2020, entered into force in March 2021, but until April 2022 this register was empty. At the moment it has 23 names.
The law obliges “individuals performing the functions of a foreign agent” to submit a report to the Ministry of Justice every six months on their foreign agency activities. The form of the report was approved by the order of the Ministry of Justice. Deadlines for submitting reports are no later than July 15 and no later than January 15.
The report should contain information about the types of “impact” of foreign sources (these can be both Russians and Russian organizations directly or indirectly associated with any foreigners, and it is useful to remember that Belarus is also a foreign country). We will have to report in detail how much money and property (land plots, residential premises, non-residential premises, other real estate, vehicles and other movable property) received from “sources” in six months, and from whom. And also how this money, movable or immovable property was used: “directly” or transferred to “third parties”.
Information about “foreign sources” should also be detailed. If this is, say, a foreign citizen, you will have to provide his passport data, place of stay or residence in Russia (if any). If a citizen of the Russian Federation “influenced” in the interests of foreigners, his passport data will also be required, if a Russian organization, you must provide its details and number in the Unified State Register of Legal Entities.
Such a method of influence as “organizational and methodological assistance” is mentioned in the order, but what it is is not deciphered.
In general, anyone who gets into the register is waiting for a “fun” future. You can’t do without consulting at least a lawyer. Of course, if he did not receive any “foreign” money during the reporting period, he can put dashes in the appropriate columns. But we must remember that, if desired, the Ministry of Justice has the right to request information from both Rosfinmonitoring and the Federal Tax Service …
Another humiliating and dreary duty is to label all your public statements and documents. In addition, the law prohibits natural persons-foreign agents from holding municipal and state positions. But this, presumably, does not concern Ms. Pugacheva.
I didn’t submit the report, or I submitted it, but not on time, or I submitted it on time, but “incompletely or in a distorted form,” or simply violated one of the rules prescribed by the order of the Ministry of Justice – wait for 30-50 thousand rubles of an administrative fine. I didn’t put a mark where I should have – from 10 to 30 thousand rubles a fine … A well-known singer, although she stopped performing, will probably pull such money. But if then during the year the “agent” misfires somewhere again, they can initiate a criminal case, and then there is a criminal record, a fine of up to 300 thousand rubles, or even up to 5 years in prison.
But that’s all for now. On December 1, the recently adopted new law “On Control over the Activities of Persons Under Foreign Influence” will come into force. The register of foreign agents will become unified, and the requirements for different categories will be unified. For individuals-foreign agents, this means toughening. Many details are not yet known – not all related laws have been adopted, not all by-laws have been developed. But reports will definitely need to be submitted more often – once a quarter, “foreign agents” – creative workers will lose the right to receive state support, will not be able to engage in educational activities among minors, and their cash deposits in Russian banks will not be insured by the state …
