LLC “Intersoyuz” from the Yaroslavl region filed a lawsuit with the Arbitration Court of the city of Moscow against the Moscow State Zoological Park for the recovery of 20 million rubles. for a walrus delivered under a state contract, I recognized “Kommersant” from the filing cabinet of arbitration cases. The auction for the supply of one individual 7-9 years old was announced in October 2020. According to the documentation, the animal had to be able to follow the commands of a person, in particular, “wait, into the water, touch, open its mouth, lie on its stomach, lie on its back, give a flipper.” The cost of the walrus was determined at 20 million rubles.
The contract was concluded with Intersoyuz LLC from the Yaroslavl region, earlier the walrus lived in the Yaroslavl dolphinarium. As Andrey Torbin, director of the company, explained, he decided to sell the walrus in connection with the change in the concept of the establishment. The walrus was delivered to the Moscow Zoo in December 2022, but died a week later. Mr. Torbin says the animal was healthy and was not properly monitored at the zoo.
“The water in the animal pool was fresh instead of salty. Fresh water is a breeding ground for microbes. They did not fully comply with quarantine conditions, they put a sea lion next to him, then a small walrus cub came with intestinal disorders, ”— told Kommersant Andrey Torbin.
In addition, according to the plaintiff, the zoo did not comply with the condition of the trainer’s constant stay next to the walrus for a month. The Yaroslavl company did not receive the money, since the acceptance of the received goods was supposed to take place ten days after the delivery. The buyer terminated the contract unilaterally. The Moscow Zoo does not agree with the lawsuit and says that the walrus was sick.
“The results of the autopsy revealed several diseases in the walrus, including chronic ones. The contract was terminated under Part 2 of Art. 475 of the Civil Code of the Russian Federation in connection with the transfer of goods with significant irreparable violations in quality, ”Kommersant was told in the press service of the Moscow Zoo.
The zoo claims that the deceased animal had enterotoxemia on the background of enteritis, renal tubular necrosis, adrenal adenoma, chronic bronchitis, chronic gastritis and a number of other diseases.
In court, Intersoyuz LLC demands that the termination and unilateral refusal to fulfill the contract be declared illegal. By the ruling of February 7, the claim was left without movement until the elimination of formal violations.
