The Primorsky District Court of St. Petersburg began to consider the claim of the prosecutor’s office for the recognition of 42 Internet links prohibited for distribution in Russia, in which the quote of the French philosopher Jean-Paul Sartre “every anti-communist is a bastard” appears. The agency believes that the phrase incites hatred and harms children. The defendant in the lawsuit is a member of the Communist Party of the Russian Federation Alexei Filippov. In the spring of 2022, he was fined for posting this quote on his VKontakte page. One of the links to be banned leads to his post. The prosecutor’s office could not find the owners of the remaining Internet addresses.

The first meeting on the suit of the prosecutor’s office was held on September 20. On it, the representative of the only defendant Alexei Filippov, Tatyana Dyachkova, stated that the claims of the prosecutor’s office were incomprehensible and vague. She was not even able to write a response to the claim and asked to ask clarifying questions to the prosecutor. Many of them related to the form of filing a claim. Ms. Dyachkova asked why there were no screenshots from a number of sites listed in the document. She noticed that five links lead to Twitter, which is blocked in Russia.

When asked why to additionally block the link of the already blocked social network, the representative of the prosecutor’s office said that this was the position of her department.

The quote by Jean-Paul Sartre, we recall, has been examined in courts since January 2022. Then the center “E” of the Ministry of Internal Affairs drew up a report on the communist Alexei Filippov on inciting hatred and enmity (Article 20.3.1 of the Code of Administrative Offenses of the Russian Federation). He posted the phrase “every anti-communist is a bastard” on his VKontakte page, for which received 10 thousand rubles fine.

The essence of the claims of the prosecutor’s office is that the quote of the French philosopher Jean-Paul Sartre “every anti-communist is a bastard” incites hatred and enmity. The Office refers to the relevant expertise of St. Petersburg State University with an analysis of this quote. The case materials (available to Kommersant) say that the quote will harm both adults and children. The agency refers to the Convention on the Rights of the Child and the Russian federal law “On Basic Guarantees of the Rights of the Child”. The authority claims that there are no 18+ markings on the links it listed, which threatens to “harm the health, moral and spiritual development” of children. The owners of 41 domains, according to the prosecutor’s office, could not be found.

Tatyana Dyachkova did not receive answers to all her questions, as judge Nadezhda Feodoridi stated that they did not relate to the essence of the claim. She ordered the plaintiff to provide screenshots of all the links listed by him by the next meeting. The meeting will take place on October 25th.
