The I Am Special Foundation is a non-profit organization that has been helping children with special needs and their parents in Yekaterinburg and beyond since 2014. Founded in 2016, ANO Spectrum-M is an organization of comprehensive assistance and support for children, adolescents and adults with mental disorders and mental illness. The structures provide assistance to about 500 families by organizing classes for children with teachers, defectologists, speech therapists, neuropsychologists, instructors of adaptive and therapeutic physical culture. NGOs also provide services of social lawyers and psychologists for parents.
In the Sverdlovsk region, about 200 state and public organizations are engaged in such activities. Many residents of the Urals resort to the help of NPOs, explained Kommersant at the I am Special fund: a queue is lined up for state suppliers, and you can get rehabilitation once a year. At the same time, the budgetary principle of financing applies to state organizations – according to pre-formed applications. NPOs, on the other hand, need to report monthly on the services already rendered and receive subsidies for them. It is these payments, explained representatives of the non-profit sector, that regional officials are delaying.
“We have nothing to pay teachers, defectologists, speech therapists and neuropsychologists,” complains Alexandrina Khaitova, president of the “I am Special” charity foundation. “We hear about the same problems from colleagues. Many suppliers wait for payments for three months and are already considering closing.” She predicts that new debts may be added to existing debts: “Suppliers receive compensation after two months. We continue to work. For October, we must be paid by December 15, for November – in mid-January. However, apparently, we won’t get it either.”
On November 22, “I’m Special” and “Spectrum-M” sent a request to the regional government demanding an explanation for the delay. “The budgetary allocations and limits of budgetary obligations provided for in the regional budget for 2022 in the amount of 285 million rubles. for the payment of compensation to social service providers, as of November 23, were spent in full, ”explained Andrey Zlokazov, Minister of Regional Social Policy. He added that “the issue of covering the deficits has been worked out” and sent to the regional Ministry of Finance. “What should suppliers, teachers and special families do is an open question,” representatives of the non-profit sector are outraged. 169 people.”
On November 25, according to the file of the Arbitration Court of the Sverdlovsk Region, “I’m special” and “Spectrum-M” filed lawsuits against the Ministry of Social Policy, its head Andrei Zlokazov and the Ministry of Finance of the region. They demand to check the execution by officials of the payment regulations within the framework of the federal law “On the Fundamentals of Social Services for Citizens in the Russian Federation”. According to representatives of organizations, problems with payments arise every year.
The Ministry of Social Policy of the Sverdlovsk Region provides systematic support to institutions that carry out the rehabilitation of children with disabilities, told Kommersant in the department: “In 2022, more than 77 million rubles have already been paid to the I am Special fund, and more than 59 million to the Spectrum-M organization. mln rub. In order to continue to continue funding, additional measures are being taken to increase the budget limits.”
Konstantin Vorobyov, a lawyer for the Need Help Foundation, says that refusals to pay subsidies to organizations, in particular, due to the lack of allocated budgets, also happen in other regions. For example, in 2022, such disputes were considered in the courts of Karelia and the Nizhny Novgorod region. “The courts confirmed the position of social service providers and indicated that the exhaustion of the allocated limits of budget obligations cannot serve as a legal basis for refusing to provide a subsidy,” the lawyer says. “Moreover, one of the decisions also mentions the position of the Constitutional Court that the possibility of refusing to reimburse organizations for the costs of providing services exempt from charging due to lack of budgetary funds does not comply with the Constitution of Russia. And payments in such cases should be made by allocating additional budgetary funds for these purposes no later than the next financial year. At the same time, Konstantin Vorobyov continues, it is already becoming a trend when regional authorities expressly state in contracts that one of the grounds for refusing to provide a subsidy is the lack of budget allocations (limits). Such norms have been introduced, in particular, in the Tyumen region, Buryatia and Crimea.
