Five essential steps to building a private house

The State Inspectorate for Real Estate of the City of Moscow told what steps need to be taken before you start building a house on your site and what needs to be done when the house is already built.

So, you are the owner of a land plot and want to build your own private house on it for permanent or temporary residence. Where to begin?

Step one

Examine the documents on the ground.

There are uniform requirements for the site. It should be intended either for gardening, or for personal subsidiary farming, or for individual housing construction.

You can find out the permitted use of a land plot from an extract from the Unified State Real Estate Register (EGRN) about the main characteristics and registered rights. This document can be obtained on the Rosreestr website, the State Services portal, or at the MFC.

By the way, the discrepancy between the actual and declared purposes of using the plots is revealed by the State Inspectorate for Control over the Use of Real Estate in Moscow.

“We pay great attention to violations related to changing the type of permitted land use. For each territory, a certain functional purpose is established, and the use of land must strictly correspond to the purpose of the provision. Often, apartment buildings are being built on private land plots intended for individual housing construction, which is a violation. The inspectorate detects and stops such cases,” explained Ivan Bobrov, head of the State Real Estate Inspectorate.

Develop a plan for the future home. It is important that the building complies with the norms of individual housing construction.

The house you have planned should be no higher than 20 meters and no more than three floors.

Rooms and premises in the house should be designed for living and various domestic needs.

And most importantly: the house cannot be divided into separate apartments – this simple restriction is needed in order to prevent the construction of apartment buildings under the guise of private ones.

After August 3, 2018 (date of entry into force of Federal Law No. 340-FZ), all private houses should be built only if there is a notice of planned construction or reconstruction. Otherwise, they may be considered illegal.

Step Three

Send a notice of construction or reconstruction to the State Construction Supervision Committee of the capital.

The easiest way to do this is through the My Documents offices by filling out a document on the planned construction or reconstruction of a residential or garden house. Also, the document can be sent by mail or filled out electronically on the portal mos.en.

Mosgosstroynadzor specialists carefully check whether the parameters of the future home do not contradict the established standards, as well as the presence of restrictions on the land. For example, related to the location of land in a protected zone.

Based on the results of consideration of the documents, you will receive a notification about the admissibility of placing a house on this land plot and your legal right to build.

It happens that during the construction process it is necessary to deviate from the original plan: change the area of ​​​​the object, the configuration of the premises or other parameters. Don’t worry: all changes in the construction process can also be notified. The State Inspectorate for Real Estate of the City of Moscow recommends submitting new notices to the same organization as before (according to paragraph 14 of Article 51.1 of the Town Planning Code – editorial note).

Step Four

Notify the authorized body of the completion of construction.

After construction, it is necessary to make a technical plan of the finished house and correct measurements. To do this, you can contact the cadastral engineer.

You must send a complete set of materials, consisting of a finished plan, documents for the site, notifications of compliance with construction parameters, to Mosgosstroynadzor in paper or electronic form. As in the case of obtaining permission, this can be done through the centers “My Documents”.

If during construction or reconstruction there were no deviations from the declared parameters, then in response you will receive a confirmation notification. Control at the stage of completion of construction is needed to confirm the legality and safety of the erected facility.

Step five

Register ownership of the house.

Until March 1, 2026, for individual housing construction and garden houses or for personal subsidiary farming, a simplified procedure for state cadastral registration and registration of rights is provided. Today, registration of rights and cadastral registration take place simultaneously, no other documents need to be done. At the same time, the exact list of papers depends on many parameters, and it is best to check it on the website of the Federal Service for State Registration, Cadastre and Cartography (Rosreestr). You will need to pay the state duty and wait for changes to the USRN.

Documents can be sent to Rosreestr independently through the MFC.
