The father wanted to “save them from paramilitary education”
In Finland, the consideration of a family lawsuit between two former spouses from Russia has been completed. In 2022, the Russian moved to Finland, taking with him two minor children. Dad explained his action by saying that the eldest child was studying in a cadet class, and the youngest had joined a paramilitary organization. The parent is sure that such upbringing was imposed on them by their mother. The mother herself knew nothing about the father’s decision – the children were taken abroad without her consent.
The Russian woman began her legal battle for her children in 2022. In December, a Russian court of first instance ruled that the children should live with their mother. However, the father argued that returning to Russia “would be contrary to Finnish principles regarding the protection of human rights and fundamental freedoms.”
The next meeting took place in Helsinki. In March 2023, the appeal court recognized that the removal of the children, of course, was not authorized, but on the other hand, the children, while living in Russia, participated in training to develop military skills. In particular, the senior in the cadet class was taught to shoot an air rifle, as well as disassemble and assemble a Kalashnikov assault rifle.
The assessors decided that there was a serious risk that, upon returning to Russia, the children would continue their education in the same spirit, which would “cause them emotional harm.” The Russian court’s decision was overturned.
The Russian woman continued her fight and filed an application with the Supreme Court of Finland. The judges of the next instance admitted that the opinion of the minors, who had previously stated that they wanted to stay in Finland, could have been formed under the influence of the father, who was closer than the mother during the trials. The Supreme Court’s decision is to return the children to their mother.
During the meetings, the father repeatedly asked to take into account that if the children returned to Russia, he would no longer see them and would not be able to take part in their upbringing. Despite the upcoming separation, the man still decided to stay abroad.
