Disabled woman sued for gossip about neighbors: she complained about the smell

Other residents didn’t feel a thing.

Neighborly showdowns in one of the high-rise buildings in the north-west of Moscow ended in the Khoroshevsky court. One lady wrote a statement to the police against a neighbor’s family for allegedly throwing eggs at her windows and burning rags in her apartment. The tenants, outraged by the unfair attacks, demanded a refutation and compensation for moral damage through the court – and won the case.

As MK found out, a real neighborly war broke out in one of the residential buildings in the Strogino area. In the spring of 2022, the Ivanyukov family (all names have been changed) began to suffer from the inappropriate behavior of a neighbor from above. Lyudmila Sergeevna made it a habit to knock on the batteries and loudly demand that they stop persecuting her. The woman was noisy day and night, screaming that she could not breathe. Ivanyuki tried to ask the neighbor to be quiet, in response, she accused them of organizing a chemical laboratory in their apartment and wanting to poison her.

The scandals continued in the summer and autumn, and at the end of October, Lyudmila Sergeevna wrote a statement to the police demanding that the Ivanyukovs be brought to justice. The woman reported to the police that the sounds of chemical production were heard from the neighboring apartment, it stinks of acid, acetone, burning from burnt rags and nuts – and this endangers her life and health, and she is already a disabled person of the second group. The Muscovite also said that Ivanyuki was threatening to kill her. However, law enforcement officers did not find confirmation of any of these data.

The statement to the police was the last straw for the Ivanyukovs: they went to court with a statement on the protection of honor and dignity. The family demanded from Lyudmila Sergeevna to refute the groundless accusations and pay them 250,000 rubles as compensation for moral damage. The mother of the family explained that since the spring of 2022, it has become impossible to live in the apartment due to the screams of the neighbor, which are heard both day and night. And her son stopped sleeping, and therefore cannot attend college.

Lyudmila Sergeevna also came to court and insisted that everything she said about her neighbors was true. The court called witnesses – residents of the same house, who confirmed that the restless citizen was really behaving noisily. Moreover, a relative of the woman said that she often visits her and has never felt disturbing odors.

As a result, Themis recognized the information disseminated by the neighbor about the Ivanyukovs as untrue, discrediting the honor and dignity of the family. Lyudmila Sergeevna was ordered to pay the Ivanyuks moral damages in the amount of 10,000 rubles and state duty expenses of 600 rubles.
