Deputy Chairman of the Constitutional Court Sergei Mavrin, speaking at the Legal Forum, said that Russia does not need to create a surrogate to replace the ECHR – national mechanisms are quite enough to protect human rights.
He stressed that the discord in relations between the Constitutional Court and the ECtHR began a long time ago and went through three stages – bewilderment, rejection and rejection. The last stage, as Mavrin specified, was connected with decisions on gay parades and same-sex marriages. A year ago, Russia withdrew from the Council of Europe and the jurisdiction of the ECtHR.
“The termination of our relations is, to a certain extent, a natural phenomenon,” he said, noting that the implementation of certain verdicts of the ECtHR required changes to the Constitution, which is impossible for a sovereign state.
At the same time, the break with Europe does not mean that the legal system of the Russian Federation has become “defective” or “invalid” and needs to create an alternative to the ECtHR.
“The idea of import substitution of the ECHR has seized the legal masses, but there is no such need,” Marvin emphasized, noting that theoretically an analogue of the ECHR can be created under any international organization of which Russia is a member.
According to the representative of the Constitutional Court, “the Russian legal system is able to effectively fulfill the role of a human rights mechanism.” “In this matter (the search for a replacement for the ECtHR -” MK “) it is necessary to take a break,” Mavrin said.
