Chernovik editor-in-chief fined for reprinting Novaya Gazeta text without reference to it

Leninsky District Court of Makhachkala fined Mairbek Agayev, editor-in-chief of the Chernovik online publication, for 60 thousand rubles. for publishing an article from Novaya Gazeta. However, the reason for the fine was not the criminal content of the reprinted text, according to the investigation, but the lack of reference to the source.

The case of an administrative offense was initiated under Part 9 of Art. 13.15 (abuse of freedom of mass media) of the Code of Administrative Offenses of the Russian Federation in relation to Mr. Agaev as an official – editor-in-chief of an online publication.

According to the material of the administrative case, in February of this year, the Chernovik website published material containing unreliable socially significant information about the actions of the Russian armed forces on the territory of Ukraine, the dissemination of which creates a threat of mass violation of public order and public safety. Later, at the request of Roskomnadzor, the editors removed this text. The explanations provided by the publication to the court indicated that the article was reprinted verbatim, without any editing, from the Novaya Gazeta website.

Making the decision, Judge Magomed Onzholov noted that, according to the law, the publication is not responsible for the dissemination of information that does not correspond to reality, if they are a verbatim reproduction of messages and materials or their fragments distributed by another publication. However, in this case, the material did not contain any notes and references to the source of the publication, he specified.
