The destructological forensic examination, which formed the basis of the criminal case to justify terrorism against director Yevgenia Berkovich and playwright Svetlana Petriychuk, is not based on science and cannot be recognized as an expert opinion, the response of the Russian Federal Center for Forensic Science (RFTSSE) under the Ministry of Justice says. document in his Telegram channel posted by Mrs. Petriychuk’s lawyer Sergey Badamshin.
The document notes that in the category of cases related to terrorism, forensic linguistic or complex psychological and linguistic examinations are carried out, which can only be carried out by the department. “Such a (complex destructological) examination as a species (genus) does not exist and cannot be included in the list (forensic examinations) for the following reasons. Destructology is not a science, as well as any area of technology, art or craft, but only such are understood by the legislation of the Russian Federation as special knowledge, ”the RFTSSE said in a response to lawyer Sergei Badamshin.
The defendants’ defense believes that the forensic examination based on the conclusion of the RFTSSE should not be taken into account by the court.
During the ongoing court session in the Khamovnichesky District Court of Moscow, the investigation asked the court to extend the accused’s arrest by two months. In turn, the defense of Ms. Berkovich suggested that the court release her on bail of 1 million rubles, TASS reports.
The initiation of a criminal case against Evgenia Berkovich and Svetlana Petriychuk became known on May 4. The reason was the play “Finist Yasny Sokol” about Russian women who were recruited online by radical Islamists to travel to Syria. According to the results of the examination, the production revealed the glorification of ISIS (“Islamic State”, a terrorist organization banned in the Russian Federation) and the ideology of radical feminism.
Svetlana Petriychuk and Evgenia Berkovich plead not guilty. The defense in court insisted that the case file refers to a reading of the play posted on YouTube, and not to a full-fledged production. Under the article on justifying terrorism, the defendants face up to seven years in prison.
Svetlana Petriychuk’s defense asked for a different measure of restraint. The screenwriter herself said that she provides parents and a sister with a child. Yevgenia Berkovich’s defense also asked to be released from the pre-trial detention center, since she has dependent children. Later Svetlana Petriychuk put for preventive registration as a person prone to a crime of a “terrorist nature and extremist orientation”.
