New fines, old summonses and long lines to see lawyers and military commissars—the autumn conscription has begun in Russia. It will last, according to tradition, until December 31. And they will begin sending conscripts to the unit on October 16, the General Staff clarified. Meanwhile, the State Duma hastened to assure that recruitment into the army will take place according to the previous rules. But this is not entirely true: firstly, starting this fall, administrative penalties for draft dodgers and organizations are being tightened. And, secondly, some new legal norms are being applied in practice. What exactly will change? Ivan Khorushevsky will tell you.

Conscription rules have been particularly inconsistent over the past year. Even during the spring recruitment into the army, Russian President Vladimir Putin signed a law on electronic subpoenas. It allows commissariats to send documents not only in paper form, but also through State Services, simultaneously placing them in a special digital register.

However, by October it had not started working; the Ministry of Digital Development stated that the database would appear at the federal level no earlier than 2025. However, in some regions – which ones are unknown – the system will still be tested this fall. Therefore, some Russians will receive electronic summonses, but they will only duplicate traditional documents, the State Duma clarified. How this will affect the legal status of online notifications remains unclear.

But what is certain is that the penalties for draft evaders prescribed in the new law will remain in effect. For example, if within 20 days from the date specified in the summons, a citizen does not come to the military registration and enlistment office, he will be prohibited from taking loans, registering an individual entrepreneur and driving a car, reminds lawyer Alexander Peredruk:

“As long as there are no military registration registers, these measures can be applied without the appropriate information infrastructure, that is, the commissioner has the right to send a request to the competent government authorities to impose a ban on driving a vehicle. And the ban is lifted in two ways: either if the citizen provides a document confirming the valid reason for his failure to appear on the summons, or if he appears on the summons.”

In the summer, the State Duma raised the conscription age: the lower limit remained the same – 18 years, but the upper limit increased from 27 to 30 years. However, the new rules will not affect the autumn enrollment; they will come into force only on January 1, 2024.

But another norm, approved by parliament in July, is already in effect. As soon as a summons is sent to a person liable for military service, travel abroad will be prohibited for him. That is, this can happen even before the document reaches the citizen.

In addition, the fine for failure to appear at the military registration and enlistment office without a good reason is increasing: from the previous 3 thousand rubles. up to 30 thousand rubles. Moreover, even those who are late to the commissariat for a couple of hours can be punished, warns lawyer, founder of the Moscow Human Rights Center Mikhail Salkin:

“If your summons says that your appearance at the military registration and enlistment office is scheduled for, for example, 10 am, and you came at 12 without a good reason, in theory, you should also be subject to administrative liability. A valid reason is a state of health, circumstances beyond your control, for example, you took a train ticket and it was late, a serious illness of close relatives or their death. In practice, I’m afraid there are no ways to notify the military registration and enlistment office other than sending a paper letter there.”

Responsibility for organizations is also becoming stricter. If a company does not provide lists of employees to the commissariat on time or does not serve subpoenas on employees, it faces a fine of almost half a million. Against this background, legal entities began to more often outsource military registration to law firms, says Alina Neretina, senior lawyer at Unistaff Payroll of Ancor holding:

“The resources available in the company simply do not have time to track these huge numbers of changes within the framework of military registration. And it is much easier to delegate this task to people who specialize in this. This is absolutely the whole range of services – filling out personal cards for employees, sending information to the military registration and enlistment office.”

In total, this fall the army should be replenished with 130 thousand people; recruits will not be sent to the LPR, DPR, Zaporozhye, Kherson or the combat zone, the General Staff promised. However, no laws were passed in Russia that would prohibit doing this.
