Fifteenth Arbitration Court of Appeal in Rostov-on-Don confirmed the decision of the court of first instance, which ruled that the “thumbs up” emoji under a message in the messenger can be regarded as a confirmation equivalent to a signature under an additional agreement.
An entrepreneur who planned to supply a customer with a kiosk in the form of a retro van offered him a color option, to which he responded with a “thumbs up” emoticon. The contract provided for the conclusion of an additional agreement to approve the color, but it was not signed, and on this basis the supplier did not deliver the kiosk on time, and then refused to return 480 thousand rubles of the deposit.
The court ruled that the emoji was sufficient for the agreement and took the client’s side.
