A resident of Reutov sued his ex-wife for 10,000 rubles for posting on social networks a post about his alimony debts. The man accused the ex-wife of illegal disclosure of his personal data.
As MK managed to find out, the Reutov city court considered the lawsuit of a local resident against his ex-wife, who demanded 750,000 rubles in compensation for moral damages from her for a post on social networks. Andrei and Maria (all names have been changed) divorced some time ago, the minor children stayed with their mother. Maria filed for alimony, but Andrei turned out to be an unscrupulous father and the family did not see the full amount of money from him. Once the woman’s patience snapped, and she decided to make the situation public. In the local public, she, on her own behalf, posted the decision of the bailiff to bring the ex-husband to administrative responsibility as part of the enforcement proceedings for the recovery of alimony. The published document indicated the full name of the debtor and all his data. In the comments to the post, Maria expressed in insulting terms everything she thinks about the father of her children. The outraged man sued his wife for this. He accused her of divulging personal data without his consent and violating his right to privacy. He was also worried that the published information could cause psychological trauma to their joint minor children and cause harassment from outsiders.
The judge concluded that Maria had indeed violated the law by posting a bailiff’s order with her husband’s data on social networks. The Law “On Personal Data” states that such information can be posted only with the consent of the subject. The woman could not provide the plaintiff’s consent to the placement and dissemination of information about his private life. The court ordered her to remove the ill-fated post from the social network and pay compensation to her ex-husband for non-pecuniary damage. But not 750,000 rubles, but only 10,000.
