A bill has been submitted to the State Duma proposing a mechanism for exempting from criminal punishment persons who entered into a contract for military service during a military operation. The initiative was prepared by deputies Pavel Krasheninnikov and Andrei Kartapolov (both from United Russia), as well as senator Andrei Klishas. Those who are under investigation, on trial or against whom a sentence has already been passed will be able to conclude a military contract.
According to the document, such a legal mechanism applies to the following categories of persons:
- suspects and accused of crimes of minor and medium gravity (with the exception of a number of crimes against public safety and against the foundations of the constitutional order and security of the state);
- convicted persons (with the exception of those who have committed crimes against the sexual integrity of minors, against the foundations of the constitutional order and state security, as well as those involved in terrorism).
If a contract is concluded with the armed forces, the cases of the suspects will be suspended, and the type of punishment of the convicted will be changed to a suspended sentence. Their behavior will be monitored by the command of military units. If, after the start of military service, a contract soldier commits a crime again, the court will impose a punishment on him, taking into account previously passed sentences. Further release from liability and expungement of a criminal record is possible if the contract soldier receives a state award, or in connection with dismissal from military service for certain reasons.
