The Southern District Military Court upheld the sentence of Corporal Madina Kabaloeva, who was found guilty of violating Part 5 and Part 3.1 of Art. 337 of the Criminal Code of the Russian Federation (failure to appear for service without good reason during the period of mobilization, conditions of armed conflict or combat operations). The woman was sentenced to six years in a general regime colony. The execution of the sentence was postponed until 2032, as the woman has a minor child.
Before the initiation of a criminal case, Madina Kabaloeva turned to the doctors of her unit, who issued her a recommendation for temporary release from military service due to pregnancy.
In court, the woman justified her failure to appear before management by having a medical certificate. According to the defendant, she was confident that the recommendation for release from service would be conveyed to the leadership of the unit.
The prosecutor’s office did not accept Medina Kabaloeva’s arguments and asked for a guilty verdict against her. The corporal, according to prosecutors, did not leave military service due to pregnancy and continued to receive allowances and enjoy the required benefits.
Lawyer Roman Rabadanov plans to appeal the verdict because he considers the court’s decision illegal.
