Merchants refused to voluntarily refund the cost of the parachute jump gift certificate

Through the court, a Muscovite had to return the money for the gift certificate, who decided that the gift was too extreme, and changed his mind about using it. The man was afraid to jump with a parachute, and the seller company refused to return the money.

As MK found out, at the beginning of November, Muscovite Roman (name changed) purchased a gift certificate from the company for unique experiences. The owner of this certificate received the opportunity to make a parachute jump. The purchase price was 26,000 rubles. The next day, Roman decided that the gift did not suit him and wanted to return the certificate. He contacted a representative of the seller’s company in correspondence and announced his intention. However, the company refused to return the money. The buyer was offered a choice of several options for resolving the situation. Return 6,000 rubles, taking into account the withholding of an amount of 20,000 rubles for the costs incurred for issuing a certificate; reissue the certificate for another person or choose a service equivalent to the cost of the certificate. Roman was not satisfied with any of these proposals. He sent a claim to the company demanding to return the entire amount for the service, which he refused. And then he turned to the Magistrate’s Court of the Tekstilshchiki district and a claim for the protection of consumer rights.

The judge sided with the plaintiff – according to the Law, the buyer has the right to refuse the purchased service, and the seller in this case is obliged to pay the entire amount, since the service was not provided. Since the company selling certificates did not do this voluntarily, it will have to return to the client not only the cost of the certificate, but also a penalty and a fine. According to the court decision, the company will have to pay 41,632 rubles to Roman in total.
