A mobilized single Russian announced a competition for a poor bride: “He will receive payments”

In Kuzbass, they are vigorously discussing the story of Vasily from the Kemerovo Region, a former orphanage who, having no close relatives, decided to marry a woman from his region so that she would get all social benefits, and in case of his death, insurance.

The story provoked controversy due to its ethical moment. Someone even thought that it would be easy to prove the fictitiousness of such a marriage, and the woman would not receive the money. “MK” talked about this with lawyers.

Vasily from the city of Belov is 35 years old, he once worked at the Listvyazhnaya coal mine, and before the mobilization he was engaged in assembling windows. On September 27, the young man received a summons, and on October 1 he ended up in the Omsk training center.

The former pupil of the Novokuznetsk orphanage has no close relatives; according to him, he issued a power of attorney for a house and a car for a childhood friend. A week ago, they brought him papers in which it was necessary to indicate the data of relatives in order to draw up insurance (all military personnel participating in the NWO are insured in case of injury or death).

“If you have no relatives, then the payments will go to the state or the fund, you had to choose,” says Vasily. But this option did not suit him. It is better to help a real person, but “the state won’t say thank you anyway,” the man reasoned, and decided to find a worthy woman who would quickly agree to become his wife.

He wrote literally the following to the local public: “Dear girls of the city of Belovo, two weeks ago I was mobilized … I am 35 years old, and it so happened that I had no relatives left, but I would like to change the life of one of the townspeople … God forbid, so that I can return, but suddenly not, and I don’t want to give insurance payments to incomprehensible funds. At the same time, he indicated that he had no criteria, just, they say, call.

After about ten telephone conversations with applicants, Vasily chose Nadezhda for the role of his wife, whose husband died at the same Listvyazhnaya mine, where Vasily had once worked, and the woman found herself alone with three children in her arms.

“I chose a person whom I can help,” the soldier explained. In addition, according to him, “she was the first to adequately respond to my request.” “She is a good woman, close to me in spirit, but so far our relationship is built on help and the desire to help her. Maybe we’ll be good friends for now,” he said. The job is almost done, the bride must come to Omsk – they plan to sign on the territory of the training center where Vasily is located (this is called “on-site registration”).

“It will be cool if they see each other and fall in love, and then he will return, and they will live happily ever after!” – says one of Vasily’s acquaintances, who does not pretend to be the bride.

This story did not leave anyone indifferent. But opinions in society were divided: there are those who called the situation “disgusting” and accused the woman of all mortal sins (“I quickly got my bearings!”), The other half considered the warrior’s impulse “noble” and “disinterested” and called his act “male” .

But can this marriage be declared invalid? After all, according to article 27 of the Family Code, which states that “Marriage is recognized as invalid … if the spouses or one of them registered the marriage without the intention of creating a family.”

Can you prove that Vasily and Nadezhda have no such intention? And if they liked each other and after his return they decided to live together, raise her children? How, then, does this dating story differ from many others when couples find each other on dating sites, on the Web, etc.?

A fictitious marriage is a marriage without the intention of starting a family. Moreover, it becomes such only if it is recognized as fictitious by the court. Not everyone has the right to sue. In the case of a fictitious marriage, such a claim may be filed by the prosecutor or the spouse who did not know about the fictitious marriage. At the same time, if there was a purpose of concluding a fictitious marriage, but in the end the marriage became real, then it cannot be recognized as invalid.

– And how do you perceive this situation?

– This is a rather complex ethical issue. On the one hand, this is budget money, and the state must protect its interests, including challenging the validity of marriage. On the other hand, if a warrior who gives his life for his Motherland decides in this way to help a needy family with children, I personally see nothing wrong with that. It is better for a widow with children than this money can disappear at some stage, get to no one knows whom.
