Night restrictions have long been recognized as illegal
More and more stringent restrictions are being introduced in the dormitories of Russian universities. Thus, at the Moscow Institute of Culture (MGIC), from December 1, a curfew was introduced on visiting the campus from one in the morning to 5.30 in the morning. Students, and there are about a thousand of them in four buildings, are indignant and demand that everything be returned as it was.
“MK” decided to find out what the situation is with curfews in other universities and what reasons there are for introducing it.
The IPCC administration justified its decision simply: “in connection with the approval of the new Regulations on the Campus and the Rules of Residence” – such notices are posted on the doors of the dorms. This “new Regulation” applies not only to students, but also to undergraduates and graduate students. They are also instructed to “contact the commandant or the dean’s office” in order to obtain a night pass in advance.
“Before this, we were also asked whether we wanted a curfew or not,” says choreography student Olga. “Everyone unanimously answered “no,” but they arranged it anyway. Supposedly for our safety. It’s very inconvenient if you stay somewhere late or stay too long with friends. Or you have to go home from work.
It’s no secret that in “Kulka” (the nickname of the cultural institute in Moscow. – Author’s note) everyone always works part-time. In nightclubs, restaurants, theaters including. All work is in the center, and the hostel is in Khimki.
All four buildings of the IPCC dormitories are located in Khimki on Library Street. State employees pay 1,000 rubles for a place in a dorm, while private renters pay about 3,000. At the same time, the apartments in three buildings “A”, “B” and “C” are quite decent, students say, these are ordinary 16-story block houses. But the renovation and sanitary condition of the rooms are often depressing: “Mice are friendly, you can eat cockroaches, mold allows you to create a high-tech style in your apartment.” Some apartments also have bedbugs.
The topic of such curfews not only in universities, but also in colleges was on everyone’s lips several years ago. In May 2014, the Ministry of Education and Science sent out a letter to all universities “On the curfew in student dormitories.” The document lists in detail the articles of the Housing Code of the Russian Federation and the Federal Law “On Education,” which are directly contradicted by the practice of “restricting access to student dormitories at night.” Like, you enter into standard rental agreements and take money for it, albeit small, so don’t create restrictions on the use of housing. The practice of writing explanatory notes for night returns was noted in a separate line in the departmental message – it was called unlawful.
However, the attractive idea of “not letting” students into the beds they themselves paid for and were assigned by law did not immediately leave the rectors’ and deans’ offices. An inspection by the Prosecutor General’s Office was needed in 2014 in order to wean some universities and secondary vocational education institutions from this practice. There were also checks in Moscow, for example, the Ostankino prosecutor’s office banned a “curfew” in the RGSU.
However, even a year later, approximately 65 universities in the country did not listen to the ministry. Universities in the North Caucasus, Astrakhan, Kuban, Buryatia, Oryol and Ivanovo regions, etc. were called “commandant’s” as they were still called. In some places, it even came to rallies.
Since then, a lot of things have “leaked”: the pandemic, lockdown and other events. Curfews at institutes and universities have been unheard of in the last couple of years. And here we go again…
By the time the number was signed, the IPCC had not responded to MK’s request. One can only guess why the revival of the “night regulations” happened at the Institute of Culture in Moscow. Or a vestige of legal nihilism. Or the beginning of some new trend, for the sake of “student safety.”
“There is a common violation when an educational organization puts internal regulations and internal rules above federal legislation,” says lawyer Stanislav Popov. – There is nothing special to explain here, such actions are illegal. Because, having entered into a rental agreement, people are limited in their rights to use housing and receive utility services.
I also noticed the references to “student safety.” I would like to note that the current regime in Moscow today does not involve the introduction of a curfew.
