The Leninsky District Court of Vladivostok satisfied the claim of the United Russia candidate in the city Duma elections, Stanislav Primachenko, to cancel the registration of the Communist Party candidate Alexander Khamadullin. The reason for the lawsuit was the production of propaganda material in the form of a banner with a QR code, which, according to the plaintiff, Mr. Primachenko, led to the Telegram channel of the Communist Party candidate Alexander Khamadullin. There was found a picture with an invitation to a debate in a school building, which the plaintiff considered to be propaganda. According to the candidate from United Russia, the communist did not have the right to do this: he took the image on the Internet, did not pay for its use and violated copyright, which is a reason for canceling the candidate’s registration.
According to the agency, the court hearing on Monday, December 18, was held with the participation of legal representatives of the parties; the candidates themselves did not appear. The plaintiff’s position was supported by representatives of the territorial election commission (TEC) “Morskaya” and TEC “Leninskaya-1”. The court examined the picture, but it was not possible to follow the QR code – it led to some other channel with two or three subscribers that did not belong to the defendant. A representative of the Communist Party of the Russian Federation stated that it is unknown whose channel it is, and the post under investigation is not propaganda, but an invitation to debate without calls or evaluations, and the controversial drawing itself, found on the world wide web, is free and available for public use.
The court did not heed the defendant’s arguments and canceled the registration of Alexander Khamadullin. The decision has not yet entered into legal force and will be appealed within five days.
