Yaroslavl land donated to the Diocese returned to the property of the mayor’s office

The Yaroslavl Diocese failed to challenge the decision of the Arbitration Court of the Yaroslavl Region on the recognition of an insignificant transaction for the sale of land plots in Tveritsy. The Second Arbitration Court of Appeal found the decision of the Arbitration Court fair and upheld the decision to return the land plots to the ownership of the Yaroslavl Mayor’s Office.
Recall that the site in Tveritsy was allocated to the Diocese by the mayor’s office of Yaroslavl in 2016 free of charge, but with the condition that the religious organization build a cultural, educational and pilgrimage center on the site. In 2019, it suddenly became clear that the Diocese, having become the owner of the land plot, demarcated it, re-registered it and sold it. Further, the plots changed hands several times, and then concentrated in the ownership of the company, which declared its desire to build an elite residential complex with a view of the Volga on the entire space of the land previously donated to the Diocese.
The prosecutor’s office checked the murky “schematosis” of transferring the land to the property of the developer, found a violation of the law in the resale scheme, and in 2021 went to court demanding that the transaction for the sale of land transferred to the intended use and resold for commercial profit be declared null and void.
The Arbitration Court considered the case for almost a year and in October last year satisfied the claim of the prosecutor’s office. An attempt to challenge the decision by the defendant, that is, the Diocese, did not bring success. The decision has entered into force.
The land is likely to be sold by the mayor’s office to the developer. I would like to believe that at the market price – that is, for hundreds of millions of rubles.
