WhatsApp faces a fine of up to 4 million rubles for not deleting prohibited information

WhatsApp for the first time can be fined for not deleting information prohibited in Russia. The administrative protocol was registered by the Magistrate’s Court in Moscow, follows from the filing cabinet of the portal of the Magistrates’ Courts.
The date for the consideration of the protocol against WhatsApp has not yet been set. The press secretary of the Tagansky Court, Zulfiya Gurinchuk, specified to Vedomosti that the claims against WhatsApp are related to the dissemination of information about the sale of drugs, which the messenger did not delete.
In addition to WhatsApp, the court once again drew up a protocol on the Wikimedia Foundation (owns Wikipedia) because of the refusal to remove information prohibited in the Russian Federation. The protocol also entered the filing cabinet of the portal of the world courts.
Both companies are suspected of violating Part 2 of Art. 13.41 of the Code of Administrative Offenses of the Russian Federation (“Non-deletion by the owner of the site or the owner of an information resource in the information and telecommunication network “Internet” of information or a web page”). The maximum fine under the article is 4 million rubles. Next, the court will set a date for the hearing and impose a preventive measure if the companies’ guilt is confirmed.

According to the materials of the case against the fund, Wikipedia did not remove the text of the rock band’s song banned in 2010, after which Roskomnadzor drew up a protocol against Wikimedia on an administrative offense. Then the representative office of the fund demanded to stop the case and not to hold the company liable, because the legal representative of Wikimedia was not notified “and was not even identified.”
For the first time in 2023, the court fined the foundation that owns Wikipedia at the end of February. Then Wikimedia received a fine of 2 million rubles. for refusing to remove publications about three military units of the RF Armed Forces.
