“United Russia” proposed for deviators from mobilization up to five years in prison

Deputies and senators of the State Duma have developed a draft law on criminal punishment for mobilization evaders. They propose to introduce a fine of 200,000 to 500,000 rubles. or in the amount of income for 1-3 years, forced labor or imprisonment for up to five years.

The authors of the bill are representatives of United Russia – the chairmen of the State Duma and the Federation Council committees on defense Andrey Kartapolov and Viktor Bondarev, the head of the lower house committee on security and anti-corruption Vasily Piskarev and his deputies.

Deputy Chairman of the State Duma Committee on Security and Anti-Corruption Ernest Valeev said “Izvestia”that the document is ready for submission to Parliament. He noted that “we are not talking about today’s partial mobilization as such.” “It’s just that in our country there hasn’t been mobilization since 1941. Therefore, many laws about it simply did not work,” said Mr. Valeev. According to him, after the announcement of partial mobilization, it turned out that Art. 328 of the Criminal Code of the Russian Federation for draft evasion applies only to conscripts. “This is wrong in principle. The relationship between the state and the citizen should be the same for everyone, regardless of whether a person is called up for the first time or not,” the deputy believes.

In Russia in early October was initiated the first criminal case on evasion from mobilization under Part 1 of Art. 328 of the Criminal Code of the Russian Federation. A few days later, the prosecutor’s office canceled the decision to initiate proceedings. Andrey Klishas, ​​head of the Federation Council Committee on Constitutional Legislation, explained that the subjects of the crime under this article are citizens “subject to conscription,” and the question of the need to amend the legislation in this part is subject to “detailed discussion” with the State Duma.

Partial mobilization in Russia was carried out from September 21 to October 28. The Ministry of Defense stated that 300 thousand people were drafted into the army.
