Ulyanovsk Candidate Removed from Election for Foreign Actions Loses in Court of Appeal

The Fourth Court of Appeal of General Jurisdiction upheld the decision of the Ulyanovsk Regional Court to cancel the registration of a candidate for deputy of the regional legislative assembly from the New People party, Alexander Kaplina. He was removed from the election for owning foreign financial instruments – shares in the Tinkoff app, which he was unable to get rid of due to sanctions.
Recall that the Regional Electoral Committee believes that Mr. Kaplin violated the requirement of federal law, according to which, by the time of filing documents for registration, candidates must “alienate foreign financial instruments.” In court, the candidate explained that he could not get rid of the shares, because after the introduction of Western sanctions, it was “impossible to sell, transfer, or get rid of in any other way,” and this situation was not regulated by law.
Nevertheless, the regional court agreed with the arguments of the electoral commission and decided to deregister the candidate, and now the appellate instance upheld it. The Regional Election Committee told Kommersant that the commission’s decision to strike the candidate off the ballots would be adopted on Wednesday, September 6.
Alexander Kaplin told Kommersant that he would appeal this decision to the Supreme Court, and then to the Constitutional Court. “There should not be such legislative gaps that restrict the rights of voters. Otherwise, it turns out that, having bought shares in 2021, due to the changed situation in the world, which I could not foresee, now for several years, due to sanctions, I have been deprived of passive suffrage and become not quite a citizen of Russia. My constitutional right has been violated,” the ex-candidate said.
It should be noted that Mr. Kaplin already has a successful experience of applying to the Constitutional Court: in 2006, he won a case there on a complaint against the decision of the head of Ulyanovsk concerning payment for housing and communal services.
