The deferment from mobilization for fathers of three children was canceled by order of the General Staff of the Armed Forces of the Russian Federation on December 21 last year. This was announced on Friday by the head of the Duma Committee on Family, Women and Children, Nina Ostanina (KPRF) and the deputy chairman of the Human Rights Council, Irina Kirkora. They told Kommersant that in December they encountered a “splash” of appeals from wives and mothers of mobilized people with many children. In January of this year, according to Ms. Ostanina, the Duma profile committee has already received 70 appeals related to the issue of canceling the postponement. Irina Kirkora and Nina Ostanina turned to the General Staff for clarification. “The wives and mothers are in a state of depression: first their husbands and sons were called up, then they were returned, and then it turned out that the deferral was cancelled. They are like on a powder keg – whether they will call again or not, ”Ms. Ostanina emphasized, adding that she was outraged by the lack of reaction from the General Staff.
Partial mobilization within the framework of the SVO, we recall, was announced on September 21 last year. Among other categories, first fathers with four minor children received a deferment from it, later, in October, fathers with three children under the age of 16 were also given a deferment. The State Duma, as Kommersant reported, considered the relevant bill, but did not adopt it. The postponement was eventually secured by a directive from the Ministry of Defense. On October 19, State Duma Speaker Vladislav Volodin announced that more than 9,500 fathers with many children had been cancelled, and they had been recalled from military units. On October 31, President Vladimir Putin announced the completion of the mobilization, but no corresponding decree was issued.
It was not possible to get a comment from the Ministry of Defense of Kommersant. On the hotline of the Ministry of Defense Daily Storm stated that the deferment for fathers with four children remains, but for fathers of three children “the issue is still being worked out.” “As soon as it is known, the official representative of the Ministry of Defense will report on this,” the Daily Storm quoted the hotline operator as saying. Nevertheless, Ms. Kirkora and Ms. Ostanina, citing representatives of the military commissariats, assured Kommersant that there would be “no re-conscription” for fathers of three children and “those who have already received a deferment cannot be re-conscripted.” Both of them referred to the statements of representatives of the military department about the absence of the need to call up fathers of many children “in connection with the completion of partial mobilization in the Russian Federation.”
The topic received a wide response, including because of the statement of the military commissar of the Trans-Baikal Territory, Yuri Shuvalov. Mr. Shuvalov, the publication reported “Chita.ru”, confirmed the “total abolition” of the deferment for fathers with three children. Military Commissar Shuvalov turned out to be unavailable for communication with Kommersant “due to being busy.”
It is worth noting that in November 2022, the Akshinsky District Court of Transbaikalia denied a local resident, the father of three children, a reprieve. The representative of the regional military commissar then pointed out in the process that “no changes were made to the federal legislation on deferrals, and the instructions of the General Staff are advisory in nature.”
According to Kommersant, as of January 2023, six such lawsuits are being considered in regional courts and higher instances. In five of them, in the first instance, the plaintiffs – mobilized fathers – were denied. In one of the claims in January 2023, the Khiloksky District Court ruled in favor of the plaintiff, ruling to reconsider the decision to call up a father of three children, a resident of Transbaikalia.
Fathers of three children in Dagestan also receive similar court refusals to postpone, lawyer Pavel Chikov said. He, in particular, cited as an example the case of Alibek Alibekov, a 24-year-old resident of Dagestan (three children born in 2016, 2018 and 2022), who was called up for mobilization on September 24. “Alibekov’s lawyer Gasan Radjabov turned to the military registration and enlistment office, where he received an answer that his principal was not entitled to delays,” Mr. Chikov said. In his Telegram channel, he published a letter from the republican military commissar Daytbeg Mustafayev, which states that there are no grounds for granting a deferment or exemption from the draft for the mobilization of Alibek Alibekov. Kommersant failed to get comments from the military registration and enlistment office of Dagestan.
Nina Ostanina told Kommersant that she had received similar requests from Stavropol. She noted that back in December she sent a telegram to the General Staff of the Russian Armed Forces asking for clarifications, but by January 13 she had not received a response.
“Every day since January 9, we have been calling the General Staff, but there is no answer,” she said. “You can’t treat people like that, to us, deputies, who could give people explanations if they themselves received a response from the department. The General Staff needs this openness when interacting with families. Irina Kirkora indicates that clarifications from the department have also been requested from the HRC: “It is likely that we will be refused, but it is already obvious that we cannot leave people without answers, we need to start interacting and clarifying real information, helping families.”
Avoiding speculation on the topic of deferment for fathers is possible only if the legislation is changed, deputy Yaroslav Nilov (LDPR), head of the State Duma committee on social policy, said on Friday. He proposed to supplement the law “On mobilization” with a norm on mandatory deferment for fathers with three children, indicating that “there is no other option.” To this, the Secretary of the General Council of United Russia, Andrey Turchak, said that the directive of the General Staff, issued in October regarding the fathers of three or more children, would continue to operate: “We worked out this issue with the Ministry of Defense in order to stop all speculation on this topic.”
