State Duma deputy Maxim Ivanov drew attention to the brisk trade in alcohol in the Ural garrison Yelan. What threatens the mobilized military such violations? MK asked lawyers about this.

State Duma deputy Maxim Ivanov, who visited the Yelan garrison, where they are preparing mobilized people to be sent to the special operation zone, drew attention to the problem of alcohol abuse.

“In Yelan we got acquainted with the way of life. There are problems, most are solved in working order. But the key one is the open trade in alcohol. The assistant went into the store, mobilized in the queue, buying alcohol: vodka, beer. There are those who are already “drunk” during the day. The saleswoman said that the alcohol trade is “too brisk,” said the State Duma deputy.

A little later, the parliamentarian reported that thanks to certain measures, namely the ban on the sale of alcohol, the situation began to improve a little.

“The situation with drunkenness has improved, discipline is improving. After our intervention, one store completely stopped selling alcohol, the second limited the trading time to two hours a day,” Maxim Ivanov wrote on VKontakte.

The parliamentarian promised that the problem would be solved, and possibly at the level of the regional government.

By the way, dry law has already been introduced in Novosibirsk near the collection points for the mobilized. The decision of the head of the region introduced a ban on the sale of alcohol in retail outlets. So, alcohol can be purchased in stores located no closer than 300 meters from the collection points of the mobilized, and also no less than a kilometer from the Novosibirsk Higher Military Command School, where they are prepared. The decision will be valid until the completion of partial mobilization.

According to a lawyer familiar with the situation, the problem is much bigger than meets the eye.

“Everything is clear with contractors,” said the interlocutor of “MK”. – He signs a contract and goes to the service with specific goals. He also recognizes and realizes that failure to fulfill the contract may lead to the termination of the contract.

With the mobilized, although they are equated with contract servicemen, the situation is different. There is no clear regulation.

Purely theoretically, the Disciplinary Charter of the Armed Forces can be applied to a mobilized military man who has drunk. Well, they put a crowd of drunken uncles in a guardhouse, so what? They are not afraid of it. The question is: did they go there for this? says the lawyer.

According to him, if, in a state of alcoholic intoxication, a mobilized person commits illegal actions, for example, arranges a drunken brawl, the military prosecutor’s office will deal with him, and if a criminal case is initiated, he will be tried under the articles of the Criminal Code.

For example, criminal cases may be initiated under the articles “Violation of the statutory rules of relations between military personnel in the absence of subordination relations between them” or “Forcible actions against the chief”.
