They want to enshrine the protection of a person’s voice by law. The professional community believes that neural networks can be a threat. Modern speech synthesis tools are capable of copying a person’s timbre and speaking any text to them. The legislative possibility of protecting citizens from such unlawful borrowings is being discussed in the Federation Council, Izvestia reports. Last week, a roundtable was held there with the participation of lawyers, broadcasters and representatives of the music industry. Why should vote protection be included in the law? There have already been precedents for “vote theft.” One of the most high-profile cases is the case of actress Alena Andronova, which Kommersant FM already talked about in the summer. She voiced a large amount of text for Tinkoff Bank, and later learned that her voice was freely used by companies in advertising, including for porn sites. The girl told her story in her personal channel:
“It all started in 2019. I was sent an invitation to the casting. I passed it. There were no details in the agreement. When I arrived at the studio, it turned out that we were recording a large array of texts for voicing a neural network. I tensed up. I was told that my voice would replace the call center. I agreed. A year ago, a friend of mine asked me if I had ever voiced over a porn ad. I say “No. All this time, my voice continued to synthesize porn, advertisements for erotic chats, even the studios with which I worked as an actress bought this synthesis.”
To avoid such cases in the future, parliamentarians propose to fix the protection of voices in the Civil Code by analogy with the image. There is a separate article dedicated to this in the bill. In addition, it is proposed to include voice in the list of intangible benefits.
And although this list is open, that is, it is not officially limited to the items listed there, clarification is still needed, says Tamara Bogdanova, associate professor of the department of civil law disciplines of the Volgograd branch of RANEPA:
“The article on the use of a citizen’s image should still be supplemented with a parameter on the citizen’s voice. If we make changes to Art. 152.1, then in fact it will work the same way as with appearance, when any person cannot, without consent, take a photograph of a person, even from free sources, and use it as he pleases. It’s the same with the voice. If this is further regulated in the Civil Code, then this will only be a plus.”
According to the bill, the owner of the voice will have the right to demand the removal of a recording from the Internet if it was distributed without his consent. Among other things, the initiative protects citizens from cases of artificial voice synthesis, with the help of which it is possible to generate the speech of a specific person without his direct participation.
The current standards for protecting voices are not enough, says Roman Lukyanov, managing partner of the law firm Semyonov and Pevzner. But, according to him, the main issue is responsibility for violators:
“On the one hand, we have a formally open list for material goods, but, as experience shows, if you don’t directly mention something in the norms, then it’s as if it doesn’t exist. Possible future regulations on voice need to be transformed into something more serious.
For example, in the field of intellectual property for certain objects, in addition to classic losses, there is compensation of up to 5 million rubles. or double the cost of the right of use. Now, if some similar measure of liability were provided for the area of unauthorized use of images and voices, then copyright holders would be more often protected, and this would be more preventable.”
The issue of the right to vote is also a concern abroad. In early August, the Financial Times reported that Google and Universal Pictures were discussing protection against speech synthesizers. They plan to license celebrity voices.
