The Sverdlovsk Regional Court upheld the decision of the Chkalovsky District Court of Yekaterinburg to ban the organization of a private crematorium in the Khimmash microdistrict. This was reported by press service regional court.
An appeal against the decision of the court of first instance was filed by Orange-S LLC, which wanted to create a private crematorium on the site of the Gabbro funeral home on Dimitrova Street, 72. The company did not agree with the decision of the district court and appealed it to a higher authority, where the appeal was not satisfied .
In October 2022, residents of the houses closest to the building appealed to the Chkalovsky District Court. Fearing for their health, they demanded to ban the operation of the facility and oblige the company to demolish it.
In June, the district court partially satisfied the citizens’ claim. The company was prohibited from organizing a crematorium. The organization was also obliged to restore the facility to its original form or demolish it by December 29, 2024. According to the court, the organization of funeral affairs is entrusted by law to local governments, but no such decision was made.
“The court found that the crematorium building was erected in circumvention of the procedures provided for by law and is an unauthorized construction. Orange-S LLC built a garage building for cleaning equipment, and then changed the purpose of the building without permission,” the report said.
The Orange-S company began construction of a crematorium next to the local cemetery in 2021. The crematorium building was registered in March 2022, and gas was supplied to the facility at the end of the year. Representatives of the organization “Orange – S” assuredthat the bodies will be burned without emissions and will not have an impact on the environment and the health of citizens.
