The Supreme Court rejected the complaint about changing the boundaries of the Sarovskaya Pustyn Monastery

The Supreme Court of the Russian Federation refused to consider the cassation appeal of representatives of the state protection department of cultural heritage objects of the Nizhny Novgorod region from changing the boundaries of the land plot of the Sarovskaya Pustyn monastery, follows from court files.
The dispute concerns the construction of a sports complex with an apart-hotel on the spit of the Sarovka and Satis rivers in the ZATO Sarov, which is being built by Sarovinvest LLC. In 2011, the company leased 53 hectares for seven years for complex development, and in 2016 the government of the Nizhny Novgorod region issued a decree restricting construction in the protection zone of a cultural site of federal significance. Sarov authorities fearthat the building of the apart-hotel will close the view of the monastery complex Sarovskaya Hermitage and the historical part of the city.
However, the developer proved in the courts that the document deprives him of the right to the intended use of the land. In addition, the building land was included in the conservation zone of the monastery without designing the borders of the protection of the OKN and a positive conclusion of the historical and cultural expertise, the courts say. However, a forensic examination found that the site does not violate the historical views of the monastery complex due to its remoteness and cannot harm the preservation of the architectural complex.
Previously, the administration of Sarov refused to issue a permit to Sarovinvest LLC to build an apart-hotel, but the company won all legal proceedings with the authorities. At the end of June, the Sarov administration raised this issue in the Legislative Assembly of the Nizhny Novgorod region. Representatives of Sarovinvest noted that in March the government of the region held a meeting with the participation of the metropolia and representatives of RFNC-VNIIEF, as a result of which agreements were reached on lowering the height of the future complex.
