The Supreme Court refused VEB.RF to recover 1.8 billion rubles from insurance companies

The Supreme Court of Russia rejected the claim of the state corporation VEB.RF, which tried to recover about 1.8 billion rubles. from four Russian insurance companies. The defendants in the lawsuit were Rosgosstrakh, Soglasie, VSK and GUTA-Insurance.
According to data files of arbitration cases, the judge of the Supreme Court of the Russian Federation Denis Tyutin rejected the cassation appeal of VEB, which asked to transfer the case for review to the Judicial Collegium for Economic Disputes.
The lawsuit is related to the actions of the arbitration manager Mikhail Kotov in the bankruptcy case of OJSC Amurmetal (Khabarovsk Territory). The procedure was initiated by the factories themselves in 2013.
Mr. Kotov was appointed bankruptcy trustee of an enterprise whose debt to VEB amounted to about 5.4 billion rubles. Mikhail Kotov refused state corporation VEB to recover a share of the proceeds of the bankrupt in the amount of $60.1 million, reported Vedomosti in January 2017. In his opinion, settlements with the creditor, whose rights are secured by a pledge, are carried out only after the sale of the subject of pledge. Subsequently, the courts found this refusal unlawful, and Mr. Kotov was removed. After that, damages in the amount of 1.8 billion rubles were recovered from VEB.RF.
The liability of the manager was insured by LLC IC Soglasie, PJSC IC Rosgosstrakh, JSC Guta-Strakhovanie, LLC BIN Insurance, whose successor after the transfer of the insurance portfolio was VSK. VEB.RF tried to recover damages from these companies, but several courts refused to satisfy the claims of state corporations. The legitimacy of these decisions was confirmed by the Supreme Court of the Russian Federation.
