The Supreme Court reduced the debt of a murderous pensioner by half a million rubles

The amount of moral damage caused to the daughter of the murdered person was reduced by this amount.

The Supreme Court of the Russian Federation ordered that mitigating circumstances of the crime be taken into account when calculating moral damages. This decision was made based on the results of the consideration of the case of a pensioner from Kazan who killed her partner.

As MK learned, the murder occurred in July 2022. The crime was preceded by a quarrel between the woman and her partner. The court found that the lady grabbed a knife and stabbed the victim several times. The man died from his wounds.

The daughter of the deceased was recognized as the victim in the case. In court, her lawyer insisted that her father’s killer should not only suffer criminal punishment, but also compensate for moral damages in the amount of one and a half million rubles, as well as funeral costs – 55 thousand rubles.

The court of first instance sentenced the woman to 8 years in a general regime colony. The court agreed that moral damage should be compensated, although it reduced its amount to a million rubles.

On appeal, the sentence was commuted, taking into account the fact that the reason for the crime was the violent actions committed by the murdered person against the convicted woman, and also that, having committed the crime, the woman tried to provide medical assistance to the victim. The punishment was reduced to 7 and a half years, but the amount of compensation remained the same.

But the criminal still believed that the sentence was too harsh and the amount of compensation too high. She asked the Supreme Court to review court decisions and reduce the amount of compensation for moral damage. In her complaint, the pensioner indicated that she receives a pension of 13.6 thousand rubles and at the same time needs medicine, so this amount is unaffordable for her. At the same time, she agreed to compensate for the funeral costs.

Having examined the case, the judicial panel for criminal cases found that the verdict against the pensioner was fair, but the amount of compensation was clearly too high. The court indicated that the facts recognized as mitigating circumstances should have been taken into account when establishing the amount of compensation. The financial situation of the convict should also be taken into account. Therefore, the court reduced the amount of compensation by half, but otherwise the verdict remained unchanged.
