As it became known to MK, today such claims are filed according to the general rule of territorial jurisdiction, namely at the location of the defendant, that is, the relevant pension authority. At that time, many pensioners do not live where he is. The innovation will help ensure access to justice for those who, due to their age, health, financial situation, need special protection.
The Supreme Court also proposes to abolish the principle of contractual territorial jurisdiction. Now a large number of central branches of large banks include a clause on territorial jurisdiction in the insurance contract, which is inconvenient for customers. The abolition of this principle will protect the rights and interests of consumers who do not actually participate in the drafting of an agreement on the procedure for resolving disputes. It will also help to avoid uneven distribution of the load between the courts of different regions. The ability to change the territorial jurisdiction by agreement of the parties will remain only for cases involving foreigners.
In addition, the draft law proposes to increase the number of cases considered in summary proceedings. Now cases are being considered in this order, the amount of claims for which is at least 100 thousand rubles, it was decided to raise this bar to 500 thousand.
