This can only be done by a higher authority

The Supreme Court of Bashkortostan officially explained the scandalous situation that occurred with the sentencing of the minor Konstantin N. This story caused a great resonance.

The boy was found guilty of committing a crime under Article 228.1 of the Criminal Code. He was in custody until April this year. Meanwhile, at the time when he was charged with these actions, Konstantin was not yet 16 years old, and this article provides for criminal liability from this age. At the same time, both the court and the prosecutor’s office considered the prosecution legal.

However, the other day the Supreme Court of Bashkortostan decided to terminate the criminal case and Konstantin’s right to rehabilitation. Many public figures demanded that the officials involved in the detention of the teenager be punished and appealed to the Human Rights Council. The author of these lines forwarded the activists’ requests to the Supreme Court.

The Supreme Court of the Republic responded that “the verification of the legality and validity of judicial acts can only be carried out in procedures specifically established by the procedural law – through consideration of the case by a higher court.” Thus, only the Supreme Court of the Russian Federation, apparently, can make a decision on holding to account judges who approved the arrest of a minor.
