The Supreme Court of Russia declared illegal the prohibition of lawyers to bring the phone to the police department for investigative actions. This is reported TASS with reference to the judgment.
“To recognize as illegal the actions of officials of the Ministry of Internal Affairs of Russia in the Tatyshlinsky district of the Republic of Bashkortostan, expressed in refusing to let the lawyer Shafikov R.R. into the police building to participate in investigative actions with his mobile phone,” the court decision says.
The Supreme Court overturned the decisions of the lower courts, which found it legal not to allow a lawyer to be interrogated by a client along with a telephone. Such a ban violates the rights of a lawyer, the Supreme Court considered.
In May 2021, the State Duma accepted a law that prohibited lawyers from bringing telephones, audio and video equipment into the colony when visiting their clients. The Federal Chamber of Lawyers believes that the initiative violates the rights of convicts and defenders.
