The Supreme Court decided: for the delay of the bus, you can claim compensation for moral suffering

The Judicial Collegium for Civil Cases of the Supreme Court of the Russian Federation indicated in its ruling that a citizen has the right to demand compensation for moral damages for a bus that was late or did not arrive at all. The basis for this decision was the case of a resident of Naro-Fominsk, near Moscow, who almost missed the train due to violations in the bus route.

To get to the Paveletsky railway station of the capital, he expected to use a regular bus, but that one, in short, simply did not arrive on time. As a result, the citizen, in order not to be late for the train, in the mode of hard time trouble, first got to the station by minibus and then to Moscow by train.

As the Supreme Court noted, “due to the fault of the defendant, the plaintiff had to run all the way to the train and the metro with a suitcase in his hands. This made the plaintiff worry and worry. train and physical suffering, expressed in a severe headache due to experiences.

However, the subsequent attempts of the citizen to receive quite modest compensation of 5 thousand rubles from the bus workers through the court were not crowned with success. So the case went to the Supreme Court. It was he who admitted that it was impossible in such a situation to release transport workers from their part of the responsibility and emphasized: “In case of non-fulfillment or improper fulfillment of transportation obligations, the carrier is liable … If a citizen has suffered moral harm … the court may impose on the violator the obligation of monetary compensation said harm.”

Thus, canceling all previous decisions on the case, the court ordered to consider it again, taking into account the definition.
