The Supreme Court has banned ultrasound without a referral from a doctor or other medical specialist
The Supreme Court of the Russian Federation did not allow the Russians to do an ultrasound without a doctor’s referral. The corresponding judicial act is posted on the website of the court.
It is clarified that the court made this decision after considering the complaint of a patient who was faced with a refusal to conduct an ultrasound in a private clinic without a referral from a physician. Plaintiff argued that the law’s requirement to obtain a prior medical referral for an ultrasound scan limited her rights. In addition, the lawsuit emphasized that the law obliges the referral specialist to indicate the location of the procedure, which negatively affects competition in the provision of services.
Soon the court received written objections from the Ministry of Health, in which the ministry announced the need to maintain existing standards to ensure the principles of safety and expediency of medical procedures. The Supreme Court took the position of the Ministry of Health.
