The state prosecution requested for the owner of the Summa group Magomedov 24 years in prison

During the debate of the parties in the Meshchansky Court of the capital, the state prosecution requested a 24-year sentence in a strict regime colony for Ziyavudin Magomedov, co-owner of the Summa group, accused of organizing a criminal community and embezzling more than 11 billion rubles. The prosecutors asked the court to impose a fine of 1.5 million rubles on the accused and restriction of freedom for 2 years after serving the sentence.

For the businessman’s brother Magomed Magomedov, the state prosecutors requested 21 years in prison and a similar fine and restriction of freedom.

Other defendants in the same case – the head of the Intex company Artur Maksidov, the former general director of JSC United Grain Company (OZK) Sergey Polyakov, the former head of the economic security department of the OZK Roman Gribanov and the general director of Energia-M Yury Petrov, were asked to appoint 18, 18, 16 and 8 years in prison, respectively, 2 years of restriction of freedom and up to 1.5 million rubles fine.

The prosecution also asked the court to satisfy the claims of the injured party for more than 9 billion rubles and leave the property and real estate of the accused under arrest for its confiscation.

Expressing their position in the debate of the parties, the accused earlier called the accusations made by them “unfounded and false” and declared their innocence.

OZK, Sibmost JSC, the Federal Air Transport Agency and other companies were recognized as victims in the case.

The Magomedov brothers and other defendants in the case are accused of organizing a criminal community and participating in it, as well as nine episodes of fraud and embezzlement.

The investigation believes that the Magomedovs created a criminal community, the heads of the structural divisions of which were David Kaplan and Eldar Nagaplov. The community includes more than 15 people. The brothers used legal entities affiliated with them, which were part of the Summa Group, as the material base of the criminal community.

According to the prosecution, from 2010 to 2016, more than 11 billion rubles were stolen under government contracts and agreements concluded with companies controlled by Magomedov.

“Despite their non-recognition of guilt, it is proven,” one of the state prosecutors said in the debate and referred to the results of economic examinations and testimonies, including secret witnesses.

The prosecutor noted: the investigation found that in the criminal group “conspiracy was observed at the highest level”, the defendants in the case, who illegally withdrawn funds, “met confidentially in restaurants”, “kickbacks” from transactions made as part of the execution of state contracts “amounted to 20-30%” .

Personally, Ziyavudin Magomedov, as the prosecutor noted, made “final decisions on important issues.” The embezzlement of budgetary funds in various regions of the country “was put on stream” by him.

One of the state prosecutors in the case is Mikhail Reznichenko, who previously represented the prosecution in the Seventh Studio case. During the debate, he also questioned the legality of Magomed Magomedov’s possession of a golden pistol, which was found in his possession during a search and, according to the accused, is allegedly a premium weapon.
