The State Duma approved new rules for serving subpoenas and penalties for non-appearance at the military registration and enlistment office

The State Duma immediately adopted in the second and third readings a law on new rules for the distribution and delivery of draft notices for military service. Military registration and enlistment offices will be able to notify citizens by mail, in person, and through the State Services portal. Refusal to take the summons from the obligation to appear at the call of the state does not release. And dodgers were promised a temporary ban on leaving, blocking their driver’s licenses, denial of consumer credit, a ban on registering a car, real estate and business.
MK has repeatedly written about a bill introduced in 2018 by a group of United Russia members from the Duma Defense Committee, in 2022 it was adopted in the second reading, and last week it was revived and now it has become law. In the course of revision, the text “swollen”: initially it was planned to amend only the Law “On military duty and military service”, but as a result, changes were made to seven other existing laws. The head of the Duma Committee on Defense, Andrey Kartapolov (“ER”), at a plenary session on April 11, explained why this was necessary: “The experience of conducting mobilization measures last year revealed serious shortcomings in the field of military registration – there were no unified databases, there was no information about a citizen’s family , the state of his health, the presence of armor “; the key task now, according to him, is “the creation of a modern information base for military registration on the basis of a single information state resource.” The law really legalizes the creation of a unified register of military registration: it will be formed by military commissariats on the basis of information from a single state information resource that has been created in the country for several years now, and will collect information obtained from information systems of various departments (the Federal Tax Service, the Ministry of Internal Affairs, courts, the Social Fund etc.), from authorities of different levels and municipalities, as well as from employers, various organizations such as medical institutions and universities, and from the citizens themselves. Moreover, citizens will be allowed to clarify information about themselves (place of residence, marital status, changes in health status) in writing or electronically.
The unified register of military registration will be created “in the manner and within the time limits established by the government,” Mr. Kartapolov recalled. And already within the framework of this register, another register will appear – “sent (delivered) subpoenas”. It is allowed to send subpoenas in writing, and duplicating them in electronic form, through the citizen’s personal account on the State Services portal. By the way, the government will also determine the procedure and timing for sending electronic summonses.
A citizen is obliged to appear on a summons received by him in any form, the adopted law says. Moreover, an electronic summons will be considered received immediately from the day it is posted in the citizen’s personal account, and a written summons from the day it is handed over by the employer, policeman, postman or military registration and enlistment office against signature or a recorded refusal to receive it. By the way, the law now allows you to hand over subpoenas to the relatives of the conscript. If the summons is not considered served by one of the above methods, it will be considered served after seven days from the date of its placement in the register of summonses.
If for some reason the summons did not come at all, although it should have seemed like, within two weeks after the start of the next draft campaign, the person liable for military service must come to the military enlistment office himself.
Refusal to appear and comply with the requirements prescribed in the law will threaten with “temporary measures” unprecedented before. Firstly, from the day when the summons is considered handed over, the conscript will be temporarily banned from leaving the Russian Federation. The decision to ban will be formed “automatically” in the same military registration register and signed by the military commissar’s electronic signature, and then sent to the citizen’s personal account at the State Services and the Ministry of Internal Affairs. The restriction will be in effect “until the obligation to appear on the agenda at the military commissariat is fulfilled.”
Other restrictive temporary measures include a ban on state registration as an individual entrepreneur, a ban on registration with the Federal Tax Service as a self-employed person, suspension of the procedure for registering real estate, and refusal to provide a loan or loan. And the person who ignored the summons will have their driver’s license suspended and the car will not be registered in his name. In addition, the authorities of the subjects of the Russian Federation receive the right to establish additional “temporary measures” on their territory – in particular, to limit the receipt of regional social payments, benefits, support measures “and other preferences.”
The authors of the amendments, which radically change the rules for serving subpoenas and accounting for those liable for military service, were deputies from all Duma factions: Andrei Kartapolov (ER), Viktor Sobolev (KPRF), Andrei Lugovoy (LDPR), Roza Chemeris (New People) and Dmitry Gusev (“SR”). The law was passed almost unanimously, with only one deputy abstaining from voting in the third reading. True, some communists expressed dissatisfaction with the fact that the text of the amendments was posted in the Duma’s electronic database of legislative work only a couple of hours before the start of their discussion in the meeting room, which made it impossible to study them in detail.
The law says that it will come into force “from the day of its official publication”, that is, literally in a few days: on April 12, the document will be approved by the senators, then the president will sign it, and that’s it. But in the same law, a reservation was made: “before the start of operation” of the same unified military registration register, military registration without a personal appearance, sending subpoenas in electronic form and the application of temporary restrictive measures “are carried out without the use of such information systems and resources.” There is no unified register now, it will work, judging by the plans announced earlier, by the beginning of 2024, not earlier.
