The Labor Code provides for four additional days off per month for parents of children with disabilities

What documents must be provided to the employer?

  • written application of the established form (in the form approved by the Ministry of Labor);
  • birth or adoption certificate of a child or a document confirming the establishment of guardianship or trusteeship of a child with a disability;
  • documents confirming the place of residence of a child with a disability;
  • ITU certificate;
  • a certificate from the place of work of the second parent, guardian or trustee stating that at the time of application, additional paid days off for this month have not been used or have been partially used.

If one parent is not officially employed, then the other employed parent must provide documents confirming this fact.

What is important to know

  • Additional days off are not provided to the parent during the period of leave: paid, without pay or to care for a child under 3 years of age. At the same time, the other parent retains the right to additional days off.
  • The number of such days does not increase, for example, if there are several children with disabilities in the family. But additional days off can be distributed between parents in any way: 1+3, 2+2. The Labor Code allows both parents to be with the child at the same time.
  • According to the new order, parents of children with disabilities can save up days off and use them as additional leave. The duration of such “vacation” is limited to 24 days. Both parents can participate in accumulation, and each of them has the right to spend their part.

The main thing is to stay within the overall limit. Accumulated days cannot be transferred to the second parent. You can use your vacation once per calendar year, from January to December. On January 1, unused days will be reset to zero and a new period will begin. The schedule of such a vacation, like any other, must be agreed upon with the employer in advance.
