Deputy of the State Duma of the Russian Federation, Chairman of the Union of Summer Residents of the Moscow Region Nikita Chaplin in an interview with “Russian newspaper” said that the board of SNT can legally exclude a gardener from the partnership, not only for non-payment of membership fees.
According to Chaplin, many gardeners are convinced that if they pay their dues to the SNT on time, then they are not in danger and cannot be excluded from the partnership, but there are a number of additions to the law, according to which you can lose your membership status for inappropriate behavior.
The parliamentarian pointed out that the grounds for exclusion from the SNT are enshrined in the main dacha law, which is 217-FZ “On the conduct by citizens of gardening and horticulture for their own needs (…)”. The deputy clarified that the current rules state that for a delay in membership fees for a period of more than two months, they can really be expelled, and also the reason for the exclusion may be the failure to comply with the decision of the general meeting of members of the partnership.
Another reason, as Chaplin noted, is non-compliance with the charter and violation of land legislation, in particular, misuse of the site, which must be confirmed by an administrative fine. At the same time, the parliamentarian added that the decision to expel is made not only by the chairman of the SNT, but by the general meeting of its members. The deputy clarified that the violator must be notified of exclusion from the partnership a month before.
