The right of Russians to compensation for delayed wages may be expanded

The Ministry of Labor and Social Protection of the Russian Federation proposed to amend the Labor Code in order to expand the right of citizens to receive compensation for unlawful delay in the payment of wages. This was announced in the department on Tuesday, May 16.
As recalled in the Ministry of Labor, the current norms guarantee the right of Russians to compensation in cases where wages were accrued, but not paid on time. If the salary was not accrued at all, the law does not guarantee the right of citizens to receive compensation payments.
This, for example, applies to cases of reinstatement of employees in the workplace by a court decision. Since no salary was accrued during the downtime until restoration, the delay in its payment does not imply compensation.
Alexander Yuzhalin, head of SuperJob’s legal practice, previously told what to do if an employer delays wages. The expert emphasized that the law does not provide for the possibility for the employer to delay the payment of wages in principle, therefore delay in wages is unacceptable.
The head of the Ministry of Labor of the Republic of Bashkiria, Lenara Ivanova, expressed confidence that not paying wages is “like stealing,” since there is an employment contract under which a person has the right to remuneration for his work.
