The number of world in bankruptcy cases has increased by 1.4 times over 5 years

The number of bankruptcy cases in Russia, in which courts terminate proceedings due to the approval of a settlement agreement, is growing every year, since 2017 it has increased by 1.4 times. Nikita Filippov, head of the DE JURE lawyers’ bureau, spoke about this at a conference “Bankruptcy-2023”organized by Kommersant Publishing House.
According to the Judicial Department under the RF Armed Forces, if in 2017 there were 1,079 such cases, then in 2021 there are already 1,495. The total number of world cases decreased only in 2020 (from 1,437 to 1,242). “The pandemic year stands apart, when the courts could not fully work for a long time, perhaps this is the reason for this fall,” Mr. Filippov said.
“Is it a lot or a little? It depends on what you compare it to. If with the number of bankruptcy cases that are initiated annually, and this is more than 270 thousand applications, then less than 1% of cases end up in the world, the expert said. — But if we compare it with the number of rehabilitation procedures that are introduced as part of bankruptcy cases in Russia, then, for example, in 2021, financial rehabilitation was introduced in only 23 cases, external management – 150 each. That is, the percentage of amicable agreements is higher than other rehabilitation procedures.
It should be noted that in the structure of the total number of amicable agreements, a large part falls on cases of bankruptcy of legal entities. From 2017 to 2021, it increased slightly – from 840 to 912, most of the world’s agreements were concluded before the pandemic in 2019 – 968 agreements. At the same time, the number of global individuals in insolvency cases has tripled – from 161 to 450, and peaked in the pandemic year of 2020 – 515 agreements at once. As for the bankruptcy of individual entrepreneurs, the number of global ones has increased from 78 to 133.
We add that for 2022, statistics are only available for the first half of the year. According to the Judicial Department, in 6 months, settlement agreements were reached in 846 cases, 517 of which concerned the insolvency of legal entities, 274 – individuals and 55 – individual entrepreneurs.
