The mother of the girl who accidentally took the pills and died of the girl was finally charged

A little girl accidentally drank several phenazepam tablets. But the investigators named the cause of death … the water with which the mother washed the stomach of three-year-old Anya (name changed – ed.)

After the first article was published in MK, they decided to toughen the preventive measure for the woman. According to Elena herself, due to the fact that she went to Moscow without permission, she personally asked for help from Bastrykin. They wanted to send the woman through the court under house arrest, while she was under house arrest. According to the defendant, she is not left alone, because she is trying to prove the guilt of doctors. “They tell me: “Len, give up your claims against doctors. We are already tired of your complaints. From the fact that you go to Moscow and stand with a poster in front of the reception head of the UK. Humble yourself, ”the woman is indignant.

The tragedy occurred on February 19, 2021. Sleeping pills in the house of this large family (there were three daughters, Anya is the youngest), according to the mother, turned out to be accidental. A close relative of Elena had died a few months earlier and she was given the remaining personal belongings, including two blisters for two tablets each.

“One of the blisters was already empty, the other contained two tablets,” the woman recalls. – I have no idea why I didn’t throw them away right away, why I kept them … I will never forgive myself for this. I put things on top of the computer table in a closed locker, there were stored computer chargers, all small things. Usually my daughter never climbed there without asking, she was generally a very obedient girl.

Anya fell to the floor: “Mom, there are a lot of you.” I take her in my arms, and the body goes limp … I understand that she ate something, that I double in her eyes “

Together with their eldest daughter, they rushed to urgently call an ambulance and wash the stomach, caused vomiting, gave the child water, about 8 glasses, until the liquid that came out of the girl became clear. Also, the victim was given an enema and bathed in the bathroom.

As experts later explained to Elena, the tablets had a sweet and sour taste. A small child could mistake them for the ascorbic acid that they gave her that winter.

An ambulance for a three-year-old traveled for about an hour. Elena could not sit and stare blankly at what was happening. Take a taxi and rush to the hospital yourself – you will get into even more traffic jams. The mother did what parents usually do in such a force majeure. I washed my stomach.

“My daughter has already recovered, now I understand that I should have stayed at home, not gone to the hospital, I would have overslept, and everything went away, because, as I now know, the dose of the drug was not lethal,” says Elena.

According to the video recording, Elena and Anya waited for about an hour in the pediatric toxicology emergency room of the GKB SMP 25. If the child was near death, why didn’t the doctors notice them at all?

“Anna tolerated the first dropper in the ward well. On the second, she vomited again. On the third, her limbs began to twitch and the phalanx of her fingers swelled. On the fourth, convulsions began, ”recalls Elena.

According to the documents, the first clinical death was ascertained at 20:00 on February 19, although Anya was taken to the intensive care unit a few hours earlier.

At 0:53 on February 21, the child died.

The post-mortem diagnosis, based on the very first local forensic examination dated April 2, 2021, was severe benzodiazepine (phenazepam) poisoning.

On July 1, 2021, the investigator appointed a commission forensic medical examination, which was carried out by experts from the State Health Institution of the Stavropol Territory “Regional Bureau of Forensic Medical Examination”. They concluded that the girl died of … purulent pneumonia. According to the results of another study – in St. Petersburg GBUZ “Bureau of Forensic Medical Examination” it was stated that phenazepam and its metabolite were not detected at all in the urine and blood of a minor Anya. Probably, the drug could come out with vomiting.

So why did she die?

The investigators put forward the only, in their opinion, version: trying to provide first aid before the ambulance arrived, Elena gave her daughter too much water, which provoked hyperhydration and, as a result, cerebral edema. At the same time, for some reason, it was not taken into account that the mother not only watered the child, but also caused her to vomit, that is, the water constantly came out. But the liquid that entered the body through droppers in the hospital remained inside – there was no outflow.

The nurse of the department testified during the interrogation that the girl was given droppers, but at the same time she did not go to the toilet and she was not put in a catheter. Because, and this is also in the case file, there were no catheters in this department. Penny catheters …

Anya did not undergo any urine tests, including chemical-toxicological and general analysis. Although, in theory, they should have. It turns out that they just pumped it up for several hours so that the phalanx of the finger even began to swell.

“She never went to the toilet. I am a nurse and do not have the right to carry out therapeutic measures without a doctor’s prescription, ”the witness said at the trial.

However, for some reason, the investigation does not take into account what happened in the hospital – it turns out, from their point of view, the actions of the doctors did not play any role at all, the only thing that matters is how Elena watered her daughter at home?

“The above unprofessional actions of the defendant in providing first aid to her young daughter were the trigger in the development of cerebral edema,” the Volgograd Investigation Department reported.

“It turns out that my wife is accused only of the fact that for an hour, while the ambulance was driving, she did not sit and calmly look at what was happening to her daughter, but tried to save her?” – says the only victim in the case, Viktor Mikhailichenko, the girl’s father.

Well-known forensic expert Elena Kuchina also believes that the doctors are at fault here, and the examinations were carried out with violations. Regarding one of them (according to which the child died of pneumonia), Roszdravnadzor also expressed his comments after the check. Many medical documents in this case with corrections, additions, strikethroughs, some of the analyzes that should have been done were not carried out, even the name and date of birth of the deceased child were mixed up.

So who is to blame for the death of a little Volgograd girl? A tragic set of circumstances? Mother? Hospital staff?

Why, with such persistence, do they want to completely close this case and appoint the only culprit – although Elena is no longer in real danger, this is a relatively “easy” article and the statute of limitations has already expired on it?

Moreover, it turned out that at the beginning a criminal case was initiated not only against Elena Mikhailichenko, but also against doctors – under the same “easy” article 109 of the Criminal Code of the Russian Federation, “causing death by negligence”, although in this case, most likely, we can talk on a more serious charge under Article 238 of the Criminal Code of the Russian Federation “providing medical services that do not meet the requirements for the safety of life or health of consumers, resulting in death.” Or, for example, about the 293rd – for “negligence”.

The statute of limitations for the first is 10 years, for the second – 6 years. With a ban on professional activities for several years.

So, the case against doctors … was closed back in January of this year. For some reason, this was done so secretly that even the only victim, Anya’s father, was not informed. He learned about everything on the eve of the final indictment of his wife. Although this is a big violation from the point of view of the law.

“I was told that both my husband and I could be limited in terms of getting acquainted with the materials in order to quickly transfer everything to the court. But this is also wrong, – Elena Mikhailichenko exclaims. We are completely powerless. Nobody hears us! And, although there was information on the portal of the Investigative Committee of the Russian Federation that our criminal case is under the personal control of Bastrykin, in fact, as I see it, here in Volgograd, no one cares.”

But if the investigation puts an end to the fault of the mother – who will guarantee that next time a similar tragedy will not happen to someone else?

And the question is very worrisome: did they buy elementary catheters in this hospital after Anya’s death …
