Moscow City Court sent for a new consideration of the criminal case against the co-chairman of the Center for the Protection of Human Rights “Memorial” (created by employees of the “Memorial” included in the register of foreign agents and liquidated) Oleg Orlov. On October 11, the Golovinsky District Court of Moscow imposed a fine on the human rights activist in the amount of 150 thousand rubles, finding him guilty of repeatedly discrediting the Russian army.
On October 26, Oleg Orlov and his lawyers filed an appeal against the verdict of the Golovinsky court. On the same day, the prosecutor’s office appealed the verdict and asked assign Oleg Orlov three years of actual imprisonment. However, during the meeting, the state prosecution asked to cancel the verdict and return the case to the prosecutor’s office. Today, December 14, the court granted the prosecutor’s request and returned the case to the prosecutor’s office.
“The court considered the appeal of the defense and the appeal from the prosecutor’s office and decided to overturn the verdict of the first instance in the Orlov case. Send the case to the Golovinsky Court of Moscow for a new trial in a different composition,” the court said (quote from TASS). The preventive measure imposed on the human rights defender in the form of a written undertaking not to leave the place remains in force.
Criminal case under Part 1 of Art. 280.3 of the Criminal Code of the Russian Federation, the 70-year-old co-founder of Memorial was prosecuted for publishing a text in which he criticized the Russian military operation in Ukraine.
